Social dumping - hotet mot den svenska modellen - en nordisk komparation om allmängiltigförklaring

Abstract
Through the membership in EU and the free movement, Sweden’s labour market has been extended to the EES-countries outer national boarders. This, together with an increased transboundary movement, EU-extension in the east, and the EU-Court´s judgements such as Laval, has put pressure on the Swedish model and more in detail the Swedish collective agreement system. This essay highlights and indicates that the Swedish model lacks an adequate method to prevent social dumping from EES-employers who posts employees to Sweden according to the Posted-Workers Directive. This essay highlights and indicates that the Swedish model lacks an adequate method to prevent social dumping from EES-employers who posts employees to Sweden according to the Posted-Workers Directive. The essay investigates if the Finish and Norwegian collective agreement system, which includes a possibility to extend collective agreements (erga omnes), to a greater extend have avoided this problem. Further, analyse the essay if a possibility to extend collective agreements could be the solution for the Swedish model to have an adequate method to prohibit social dumping. It is also discussed, what possible consequences a system like the Finish or Norwegian could result in for the Swedish model. (Less)

Genom EU-medlemskapet har Sveriges arbetsmarknad utvidgats till EES-medlemsländers yttre gränser i och med den fria rörligheten. Detta, tillsammans med en ökad gränsöverskridande rörelse, EU-utvidgningen i öst, samt EU-domstolens praxis i form av Lavaldomen, har satt press på den svenska modellen och mer närmare det svenska kollektivavtalssystemet. Uppsatsen uppmärksammar och påvisar att den svenska modellen saknar en adekvat metod att motverka social dumping från EES-arbetsgivare som utstationerar arbetstagare till Sverige enligt Utstationeringsdirektivet.
