Bistå nödställd? - En undersökning om en civilkuragelag bör införas i svensk rätt

I Sverige finns det ingen lagstadgad skyldighet att bistå nödställda personer. Undantag finns i vissa situationer när det framgår av lag eller allmänna principer. Att se på när en okänd människa drunknar utan att hjälpa till, trots att personens liv enkelt kan räddas är idag straffritt. Syftet med denna uppsats är att med hjälp av en rättsdogmatisk metod utreda om en civilkuragelag bör införas i Sverige. Införandet av en civilkuragelag kommer att innebära att det finns en straffrättslig skyldighet att bistå nödställda personer, är det önskvärt att införa en sådan lag i svensk rätt?

I Sverige finns det ingen lagstadgad skyldighet att bistå nödställda personer. Undantag finns i vissa situationer när det framgår av lag eller allmänna principer. Att se på när en okänd människa drunknar utan att hjälpa till, trots att personens liv enkelt kan räddas är idag straffritt. Syftet med denna uppsats är att med hjälp av en rättsdogmatisk metod utreda om en civilkuragelag bör införas i Sverige. Införandet av en civilkuragelag kommer att innebära att det finns en straffrättslig skyldighet att bistå nödställda personer, är det önskvärt att införa en sådan lag i svensk rätt?

Införandet av en civilkuragelag kommer att innebära att strafflagstiftningen blir mer proportionerlig och majoritetens moral kommer att införas i lagstiftningen. Samtidigt kan det finnas problem med en sådan lagstiftning eftersom människor som bevittnar en olycka kan bli osäkra vad lagen kräver av dem i den aktuella situationen. Det kan vara mycket svårt att avgöra när en persons liv är i fara och hur farlig en räddningsinsats faktiskt är. Detta är omständigheter som kan medföra att vittnen till olyckor och slagsmål blir mer obenägna att hjälpa till. Det finns alltså en risk att lagen blir kontraproduktiv och frågan är om det är värt att införa en sådan lag av moraliska skäl om lagen leder till att färre människor hjälper till.

Ur ett moralfilosofiskt perspektiv finns det en skyldighet att bistå personer i nöd. Från en utilitaristisk synvinkel kan det vara svårt att avgöra om detta är något som skall lagstiftas om eftersom en utilitarist alltid måste se till konsekvenserna av sina handlingar och välja det alternativ som ger mest nytta för flest personer. En pliktetisk syn på moral är att det inte går att lagstifta om moral eftersom det är en grundläggande princip i sig som inte ska vara föremål för statligt tvång.

Avslutningsvis konstateras att det finns mer negativa konsekvenser av införandet av en civilkuragelag än det finns fördelar. Slutsatsen blir att en civilkuragelag inte är önskvärd i svensk rätt och den bästa lösningen blir att utvidga garantläran för att förhindra moraliskt oacceptabelt beteende i samhället. (Less)

In Sweden there is no statutory duty to rescue distressed persons. Exceptions can be made when this is required by a special law or by legal principles, but watching an unknown person drown when his life easily can be saved is not illegal. The purpose of this essay is to, by using a traditional judicial method, examine whether this behaviour should be criminalized or not.

If the duty to rescue distressed persons were legally required in Sweden the law would be more proportional and the majority’s morality would be incorporated in to the law. In Sweden there is no statutory duty to rescue distressed persons. Exceptions can be made when this is required by a special law or by legal principles, but watching an unknown person drown when his life easily can be saved is not illegal. The purpose of this essay is to, by using a traditional judicial method, examine whether this behaviour should be criminalized or not.

If the duty to rescue distressed persons were legally required in Sweden the law would be more proportional and the majority’s morality would be incorporated in to the law. At the same time, there may be problems with people who witness an accident and become uncertain what the law requires of them in the current situation. It can be very difficult to determine when a person’s life is in danger and how dangerous the rescue operation actually is. These are factors which may cause witnesses to accidents to become more reluctant to help. There is a risk that the law will be counterproductive, and the question is whether it is meaningful to introduce such a law on moral grounds if the law will lead to fewer people helping those in need.

From a moral perspective, there is an obligation to assist people in need. From a utilitarian’s point of view, it may be difficult to determine if this is something that should be legislated, because a utilitarian must always act according to the highest happiness of the highest number. An ethical approach to morality is that you cannot legislate morality as it is a fundamental principle in itself that should not be subject to state coercion.

The conclusion of this essay is that there are more negative consequences of a statutory duty to rescue others than there are positive effects. Therefore this type of law shall not be incorporated into the Swedish legal system. (Less)
