Internet har inneburit en förändring ur många många aspekter. Tekniken har medfört förändringar för hur vi kommunicerar, samlar in och delar med oss information och material m.m. Denna utveckling har medfört ett flertal intressekonflikter. Det kan handla om att skyddat material, till exempel upphovsrättsskyddad musik, kan spridas utan rättighetsinnehavarens medgivande eller att personuppgifter eller information om en enskild person sprids på nätet. Dessa intressekonflikter kan i flera avseenden hanteras genom existerande rättsregler och rättsprinciper. I andra avseenden har ny reglering införts. Internet har inneburit en förändring ur många många aspekter. Tekniken har medfört förändringar för hur vi kommunicerar, samlar in och delar med oss information och material m.m. Denna utveckling har medfört ett flertal intressekonflikter. Det kan handla om att skyddat material, till exempel upphovsrättsskyddad musik, kan spridas utan rättighetsinnehavarens medgivande eller att personuppgifter eller information om en enskild person sprids på nätet. Dessa intressekonflikter kan i flera avseenden hanteras genom existerande rättsregler och rättsprinciper. I andra avseenden har ny reglering införts. Bland annat har E-handelsdirektivet införts som bland annat harmoniserar medlemsstaternas regler för tjänsteleverantörer som tidigare reglerades separat inom varje medlemsstat. I direktivet återfinns ett ansvarsskydd för tjänstelevererande mellanhänder som levererar någon av informationssamhällets tjänster. Detta ansvarsskydd har införts för att skydda tjänstelevererande mellanhänder från ansvar för olika lagbrott. Motivet bakom detta ansvarsskydd är att skydda dessa mellanhänder på grund av att de ofta hanterar stora mängder information och har svårt att kontrollera all information som passerar genom deras tjänster. En tolkningsproblematik som vuxit fram är huruvida söktjänsteleverantörer skall omfattas av detta ansvarsskydd. Frågan om tillämpligheten och omfattningen av ansvarsskyddet har vid ett antal tillfällen prövats av EU-domstolen men har i dagslägen inte prövats i förhållande till söktjänsteleverantörer. Denna uppsats tar sikte på att utreda huruvida söktjänsteleverantörer omfattas eller bör omfattas av detta ansvarsskydd. (Less)

The technology has brought changes in how we communicate, retrieve and share information and material etc. This development has resulted in several conflicts of interests, that encompass protected material such as copyrighted music that can be shared without the consent of the copyright owner or that private information about an individual is circulated online. These conflicts of interests can in several aspects be dealt with through existing rules of law and legal principles. In situations where existing legal framework is insufficient new regulation has been amended. Among other regulation the E-commerce directive has been amended to harmonize the EU member states regulation of intermediary service providers. This directive provides a liability protection for intermediary service providers that provide one of the information society’s services in article 12-14. This liability protection as been adopted in order to protect these intermediary service providers from liability from a variety of criminal and civil charges. One of the motives behind this protection is that these intermediaries handle a vast amount of data and are usually unaware of what data are transmitted in each individual transmission and are often unable to prevent each individual violation. One problem raised in the application of the directive. Namely that of the search engines ability to use this liability protection. This thesis aims to shed some light on this issue and determine search engines ability to use the liability protection. (Less)
