Den straffrättsliga legalitetsprincipen ställer upp krav på att det måste finnas stöd i lag för att en gärning ska kunna utgöra brott och straff kunna utdömas. När HD för första gången skulle tillämpa straffskalan för mord sedan den ändrats i juli 2014 var principen central. HD valde att bortse från lagändringen från 2014 med hänvisning till att dess syfte inte gick att förena med lagtexten och att det därför hade varit i strid mot legalitetsprincipen att tillämpa straffskalan enligt lagmotiven. HD valde att bortse från lagändringen från 2014 med hänvisning till att dess syfte inte gick att förena med lagtexten och att det därför hade varit i strid mot legalitetsprincipen att tillämpa straffskalan enligt lagmotiven. Detta väcker frågor om legalitetsprincipens betydelse vid tillämpning av straffskalor och tolkning av straffbestämmelser. Riksåklagaren har kritiserat domen och sagt att HDs syn på legalitetsprincipen är okänd sedan tidigare. Syftet med denna uppsats är att utreda om det är så som riksåklagaren påstår.

Meningen med legalitetsprincipen är att främja rättssäkerheten genom att skapa förutsebarhet inom straffrättskipningen. Förutsebarheten kan dock inte få fullt genomslag i praktiken. Intresset av en flexibel och nyanserad straffmätning gör att det i straffbestämmelser måste tillåtas ganska vida straffskalor och hur de ska tillämpas får utvecklas i praxis genom läsning av förarbeten och med hänsyn till den allmänna rättsuppfattningen. Relevant är också att en straffbestämmelse på grund av språkets obestämdhet och verklighetens komplexitet alltid måste tolkas. Legalitetsprincipen kräver då att det måste vara en rimlig tolkning av gällande lag.

Det verkar som att den betydelse HD gav legalitetsprincipen i stora drag är främmande. Det verkar inte vara i strid med legalitetsprincipen att ett konkret straff inom en straffskala inte kan förutses och att låta förarbetena till en straffbestämmelse ge ledning i tillämpningen av straffskalor. Att bortse från lagändringen på grund av att motiven inte fått tydligt genomslag i den antagna lagtexten synes också vara ett nytt sätt att se på legalitetsprincipens krav vid tolkning av straffbestämmelser och jag bedömer det som inte önskvärt ur ett rättssäkerhetsperspektiv. Abstract
The principle of legality in criminal law demands that there must be support in law for an act to constitute a crime and for penalties to be imposed. When the Swedish Supreme Court for the first time was to apply the range of punishment for murder since it changed in July 2014 the principle of legality was of major interest. The Supreme Court chose to ignore the change from 2014 on the grounds that its aim could not be reconciled with the text of the law and that it had been in breach of the principle of legality to apply the range of punishment according to the preparatory work. The principle of legality in criminal law demands that there must be support in law for an act to constitute a crime and for penalties to be imposed. When the Swedish Supreme Court for the first time was to apply the range of punishment for murder since it changed in July 2014 the principle of legality was of major interest. The Supreme Court chose to ignore the change from 2014 on the grounds that its aim could not be reconciled with the text of the law and that it had been in breach of the principle of legality to apply the range of punishment according to the preparatory work. This raises questions about the importance of the principle of legality when courts are meting out of punishment and interpreting criminal provisions. The Prosecutor-General has criticized the Supreme Court’s ruling and said that this view on the principle of legality is previously unknown. The purpose of this paper is to investigate if that is the case.

The purpose of the principle of legality is to promote the rule of law through foreseeability in criminal justice, although foreseeability can’t have full effect in practice. The interest of a nuanced sentencing means that fairly broad ranges of punishment must be allowed. The meting out of punishment within the range will be developed in practice by reading the preparatory work and with the general sense of justice in mind. Also relevant is that a penalty provision because of the vagueness of the language and the complexity of reality must always be interpreted. In this respect the principle of legality demands a reasonable interpretation of the law.

It seems like the meaning the Supreme Court gave the principle of legality is fairly unfamiliar. It should not be in conflict with the principle of legality that a concrete penalty in a range of punishment cannot be foreseen and to let preparatory work provide guidance in the application of penalties. To ignore the change in the law because its aim is not given a clear impact in the adopted text of the law appears to be in conflict with the rule of law. (Less)
