- Since public international law is a current area of law today, we may think that it is also a modern product, a result of today’s globalized world. However, that is not the case. Public international law has important historical aspects that must be considered.
This paper examines in what way Hugo Grotius and Emer de Vattel treated two of the key concepts of public international law, state and sovereignty, and by doing so, built the foundation for public international law. Today, the sovereign states are the most important subject of public international law and also the legislators of the area. This paper examines in what way Hugo Grotius and Emer de Vattel treated two of the key concepts of public international law, state and sovereignty, and by doing so, built the foundation for public international law. Today, the sovereign states are the most important subject of public international law and also the legislators of the area. Already in the version of public international law founded by Grotius and de Vattel, the states played an important role. During the time they were active, in the 17th and 18th century, the state idea evolved.
Today’s sovereignty concept is similar to the one Grotius and Vattel created. However, unlike contemporary public international lawyers, they considered it to be more appropriate with one single person ruling the sovereignty, a so called sovereign.
Many of Grotius’ and de Vattel’s ideas about state and sovereignty are still applicable, and we can therefore say that they have had great significance for public international law and its development. Their works On the Law of War and Peace and The Law of Nations are the foundations for public international law today. (Less) - Abstract (Swedish)

Denna uppsats undersöker hur Hugo Grotius och Emer de Vattel behandlade de centrala folkrättsliga begreppen stat och suveränitet, och på så sätt la grunden för nutidens folkrätt. Dagens suveränitetsbegrepp påminner i teorin mycket om det som Grotius och de Vattel förespråkade. Dock menade de, till skillnad från vår tids folkrättsjurister, att det i praktiken var mest lämpligt att suveräniteten tillföll en enskild person, en suverän.
Många av Grotius och de Vattels tankar angående stat och suveränitet lever kvar, och är relevanta, än idag. På så sätt kan man säga att de har haft stor betydelse för folkrättens tillkomst och utveckling, och att deras verk On the Law of War and Peace och The Law of Nations lade grunden för det rättsområde folkrätten är idag.
