Aberratio ictus kan åskådliggöras genom det kända typfallet där A har upp-såt att döda B, men missar och istället dödar C, gentemot vilken A inte har någon form av uppsåt. Med andra ord är konsekvensen av A:s gärning avvi-kande i förhållande till dennes uppsåt i det avseende att ”fel” angreppsob-jekt har drabbats. Det är ett klassiskt straffrättsligt problem vilket ännu tycks sakna en tillfredsställande lösning. I svensk doktrin presenteras två lösningar för att hantera den uppkomna situationen. Med specialitetsmodellen döms gärningsmannen utifrån dennes konkreta och bestämda uppsåt, och följaktli-gen för uppsåtligt brott gentemot B samt oaktsamhetsbrott i förhållande till C. Med andra ord är konsekvensen av A:s gärning avvi-kande i förhållande till dennes uppsåt i det avseende att ”fel” angreppsob-jekt har drabbats. Det är ett klassiskt straffrättsligt problem vilket ännu tycks sakna en tillfredsställande lösning. I svensk doktrin presenteras två lösningar för att hantera den uppkomna situationen. Med specialitetsmodellen döms gärningsmannen utifrån dennes konkreta och bestämda uppsåt, och följaktli-gen för uppsåtligt brott gentemot B samt oaktsamhetsbrott i förhållande till C. Denna modell kan anses vara mer inriktad på rättssäkerhet, vilket kontras-teras av den mer klanderorienterade ekvivalensmodellen. Med sistnämnda lösningsmodell döms istället gärningsmannen för uppsåtsbrott gentemot C, trots att A:s uppsåt alltså inte kan sägas ha varit inriktat på C.

Denna framställnings syfte är att ingående undersöka, analysera och reflek-tera kring aberratio ictus-problematiken. Den huvudsakliga frågeställningen kan sägas lyfta problemet till en rättsfilosofisk nivå, då den tar sikte på frå-gan om varför problematiken existerar. Uppsatsen konstaterar att rättsläget får anses vara relativt oklart, även om specialitetsmodellen får förmodas ha företräde i dagsläget. Vidare utreder och analyserar arbetet en rad problema-tiska aspekter, däribland täckningsprincipens närmare innebörd samt rättsfi-losofiska begrepp såsom klandervärdhet och slump. Den avslutande reflekt-ionen utmynnar i ett resonemang kring en eventuell konflikt mellan den straffrättsliga begreppsbildningen och det moraliska strävandet att ålägga rättmätigt klander. I förlängningen kan denna konflikt anses härstamma från den rättsideologiska frågan rörande förhållandet mellan rätt och moral. (Less)

Aberratio ictus can be illustrated with a case, where A, with an intention to kill B, misfires and instead kills C, an unintended victim. The consequences of A’s action can be described as a deviation from his intention, as the result was indeed unintended. It is a classical problem in the field of criminal law. Even to this day the absence of a satisfying solution is evident. The Swedish doctrine presents two ways of solving the difficulties caused by this situa-tion. With “specialitetsmodellen” A is convicted on the basis of his concrete and specific intention, and thus convicted of the intentional attempt to kill B and for the unintentional killing of C. The consequences of A’s action can be described as a deviation from his intention, as the result was indeed unintended. It is a classical problem in the field of criminal law. Even to this day the absence of a satisfying solution is evident. The Swedish doctrine presents two ways of solving the difficulties caused by this situa-tion. With “specialitetsmodellen” A is convicted on the basis of his concrete and specific intention, and thus convicted of the intentional attempt to kill B and for the unintentional killing of C. This model can be said to be in well accordance with the legal system and the terminology it uses. It is contrast-ed by “ekvivalensmodellen”, which to another extent focuses on the blame-worthiness of the perpetrator (A). Thus, with the latter approach A is con-victed of the intentional killing of C, even though his intention was not di-rected against this person.

The aim of this thesis is to thoroughly investigate, analyse and reflect upon the problems of aberratio ictus. The main objective can be described as the elevation of the problem to a higher level, in terms of a legal philosophical perspective, and raise the question of why this peculiar problem exists. The thesis concludes that the legal position in regards of aberratio ictus appears to be rather ambiguous, although “specialitetsmodellen” arguably can be considered to be the favoured one as of today. Furthermore, the thesis in-vestigates and analyses several problematic aspects, such as the exact impli-cation of “täckningsprincipen” as well as legal philosophical terms such as blameworthiness and coincidence. The reflection, in regards of the main question, puts forward the argument of a possible conflict between the con-cept formation of criminal law and the moral endeavour to put just blame on the perpetrator, as a probable explanation. Ultimately this conflict can be derived from the legal-ideological question regarding the relation between law and moral. (Less)
