- Den här uppsatsen handlar om bevisvärdering av vittnesmål och hur svenska tingsrätter och hovrätter bedömer en vittnesutsaga beroende på om vittnet är polis eller inte. Syftet med uppsatsen är att undersöka om det är någon skillnad på hur domstolar bedömer ett vittnesmål beroende på om det är en polis eller en civil person som vittnar, och om det finns en skillnad, om det innebär en risk för en snedvriden bevisvärdering. Syftet med uppsatsen är att undersöka om det är någon skillnad på hur domstolar bedömer ett vittnesmål beroende på om det är en polis eller en civil person som vittnar, och om det finns en skillnad, om det innebär en risk för en snedvriden bevisvärdering. Vad som omfattas av uppsatsens syfte är således att undersöka domstolarnas resonemang och vilka konsekvenser dessa kan få, och inom ramen för detta syfte undersöks om de måttstockar domstolen använder är adekvata för en stringent och objektiv bevisvärdering. De frågeställningar uppsatsen ska besvara är: om poliser är mer pålitliga som vittnen än civila, hur polisers vittnesmål värderas i jämförelse med civilas, och om det finns risk för att domstolarna övervärderar polisvittnesmål.
För att uppfylla syftet har en rättsfallsstudie genomförts med domar från svenska tingsrätter och hovrätter. Rättsfallsstudien har undersökt användningen av vissa specifika bevisvärderingsparametrar och huruvida användningen av dessa parametrar skiljer sig åt mellan polisvittnen och civila vittnen. För att analysera resultatet från rättsfallsstudien på ett kvalitativt sätt har vittnespsykologiskt material använts som komplement till det juridiska materialet.
Resultatet från rättsfallsstudien tyder på att domstolarna generellt tillmäter polisvittnesmål högre bevisvärde än civila vittnesmål. De flesta av de undersökta parametrarna som används för att stärka bevisvärdet är också vanligare hos polisvittnesmålen än de civila vittnesmålen. Med beaktande av att de parametrar domstolarna använder i sin bevisvärdering kan ifrågasättas ur ett vittnespsykologiskt perspektiv, visar studien att det finns en risk att polisvittnesmål övervärderas i svenska domstolar. - This essay concerns the issue of evidence evaluation, and more specifically, how Swedish District Courts and Courts of Appeal evaluate testimonies from witnesses depending on whether the witness is a police officer or a civilian. To fulfil the purpose of the essay a case study has been conducted with cases from Swedish District Courts and Courts of Appeal. The case study has examined the use of specific evidence evaluation parameters and whether the use of those parameters differs between the police witnesses and civilian witnesses. To analyse the results from the case study in a qualitative manner, witness psychology has been employed as a complementary approach to legal research.
The result from the case study indicates that the courts generally award police testimonies higher evidential strength than civilian testimonies. Most of the examined parameters that are positive for the value of the testimony are also more frequent in police testimonies than in civilian testimonies. Given that the parameters the courts employ for their evidence evaluation can be questioned from a witness psychology perspective, the study thus shows that there is a risk that police testimonies are awarded excessive evidential strength in Swedish courts.
