- Avtalstolkning är ett komplext och svåröverblickbart ämne. Det är inte lätt att säga hur man ska gå tillväga vid tvist om tolkningen av ett avtal, eftersom situationen kring ett avtal kan variera i så hög grad. Börjar man undersöka specifika avtalstyper ser man att tolkningen ändå delar en gemensam grund, om än en grovt generaliserad sådan. Förutom grunden har olika avtalstyper säregna drag som gör att tolkningen skiljer sig från hur avtalstolkning ser ut i allmänhet.
Inom arbetsrättens område spelar kollektivavtalet en viktig roll. Följaktligen är det särskilt intressesant att undersöka hur kollektivavtalstolkning skiljer sig från avtalstolkning i allmänhet. I utredningen hittas fler likheter än skillnader mellan avtalstypernas tolkningsprocesser och det leder till en diskussion om nyttan med uppdelningen i olika avtalstyper. Jag kommer fram till att tolkningen är uppdelad mer än vad som behövs och att rättstillämpningen skulle vinna på en strävan mot större likhet, det vill säga att lika fall borde behandlas lika. If you start to look into specific contract types you can see that the interpretation share a mutual foundation, even though it’s a rough generalization. Aside from the mutual foundation, different contract types has separate features which makes the interpretation differ from how contract interpretation looks like in general.
Within labour law the collective agreement is of great importance. Consequently it’s of significant interest to explore how the interpretation of collective agreements differ from contract interpretation in general. The purpose of the essay is to search for similarities and differences between interpretation processes to find out if the interpretation of the collective agreement stand out in any crucial way.
The investigation indicates that there are more similarities than differences between the interpretation of different contact types. The result leads to a discussion about why the division between different types of contracts was created and if the division is required. I come to the conclusion that contract interpretation is divided more than necessary, and that the division sometimes prevents law enforcement to judge cases equally. (Less)
