Arbetsmarknadens parter är eniga om att missbruk skapar svår problematik på arbetsplatsen. Likväl menar parterna att arbetsplatsen är en social arena där den missbrukande arbetstagaren kan få hjälp. Missbruksproblematiken härstammar i att frågan är av både medicinisk- och social karaktär varför det svårt att veta hur den ska hanteras juridiskt.

Arbetsdomstolen har ställts inför utmaningen att utforma prejudicerande regler om vad som bör tillämpas generellt i arbetsrättsliga tvister om alkohol- och narkotikamissbruk, främst i uppsägning- och avskedsmål. 1984 skrev domstolen att på grund av alkohol och narkotikas säregna karaktärer kan samma regler inte tillämpas.

Mot denna bakgrund var syftet med uppsatsen att fastställa gällande rätt genom att skapa en systematik av den rättspraxis som har hanterat frågan om alkohol- och narkotikamissbruk i uppsägnings- och avskedstvister för att fastställa huruvida Arbetsdomstolen tillämpar samma regler för alkohol- och narkotikamissbruk eller inte. Förhoppningen var att bidra med en större rättslig förutsägbarhet.

Rättsutredningen ledde till slutsatsen att domstolen idag gör främst en relevant skillnad mellan alkohol och narkotika; alkoholmissbruk kategoriseras främst som sjukdom och narkotikamissbruk som misskötsamhet. Det har lett till att domstolen i sin helhetsbedömning har bedömt narkotika mer strängt. Anledningarna bakom denna slutsats är inte bara alkoholens och narkotikans säregna karaktärer utan också processrättsliga skäl. I övrigt tillämpas samma bedömning. (Less)

The social partners agree that abuse of alcohol and narcotics creates severe problems in the workplace. However, the parties state that the workplace is a social arena where the abusive employee can get help. The question about abuse of alcohol and narcotics is of both a medicinal- and a social character, why, in a legal perspective, it is difficult to handle.

The Labour Court has been faced with the challenge of concluding precedents about which regulations should apply generally in employment disputes about the abuse of alcohol and narcotics, mainly in disputes regarding dismissal and termination. In 1984 the court wrote that the same rules cannot apply to the abuse of alcohol and narcotics, due to their differences.

The social partners agree that abuse of alcohol and narcotics creates severe problems in the workplace. However, the parties state that the workplace is a social arena where the abusive employee can get help. The question about abuse of alcohol and narcotics is of both a medicinal- and a social character, why, in a legal perspective, it is difficult to handle.

The Labour Court has been faced with the challenge of concluding precedents about which regulations should apply generally in employment disputes about the abuse of alcohol and narcotics, mainly in disputes regarding dismissal and termination. In 1984 the court wrote that the same rules cannot apply to the abuse of alcohol and narcotics, due to their differences.

The aim of this thesis was to interpret and analyse legal material and case law from the labour court with a systematic approach to conclude whether the labour court applies the same regulations on the abuse of alcohol and narcotics, or not. The hope was to provide greater legal predictability.

The essay concludes that the court makes only one relevant difference between the abuse of alcohol and narcotics; the abuse of alcohol is considered a sickness, whilst the abuse of narcotics is considered to be negligence. This has led to the court, in its overall assessments, to take on a harsher stance against narcotics. The reason behind this conclusion is not only the different characters of alcohol and narcotics, but also the procedural grounds in a Swedish employment dispute.
