Ett sekel av lagrådsgranskning - En rättshistorisk och komparativ analys av det svenska Lagrådet

Abstract (Swedish)
Det svenska Lagrådet har uppgiften att granska lagar under lagstiftningsarbetet. Det bildades 1909 eftersom Högsta domstolen, som tidigare hade denna roll, var överbelastat av alla de nya lagar som skapades.

Under det dryga sekel som det svenska Lagrådet har existerat så har det skett ett antal förändringar. Denna uppsats analyserar vilka förändringar som har skett och varför. Den jämför även det svenska Lagrådet med Finlands motsvarighet.

Lagrådet har gått från att i sin ungdom vara politiskt i sin laggranskning till att vara juridisk-teknisk i den mån det är möjligt att undvika att vara politisk när man behandlar juridik. Andelen lagar som blir föremål för laggranskning har även de förändrats under åren.

Förändringarna kan tillmätas både demokratins intåg och de politiska ställningar som frodas där. Det finns en tydlig indelning i politiska läger, där högern har velat behålla eller utöka Lagrådets makt och Socialdemokraterna velat begränsa den.

Den finska laggranskningen är kraftigt försvagad jämfört med den svenska, åtminstone i fall där grundlagen inte aktualiseras (Less)

The Swedish legal council is responsible for legal preview in the Swedish process for creating new laws. It was created 1909 because the supreme court, which was previously responsible for legal preview, was overrun by the amount of new laws.
During the roughly one hundred years that the legal council has existed, a number of changes have been made. This essay analyses which changes
have come to pass, and why. It also compares the Swedish legal council to the Finnish equivalent.
The legal council has moved on from the very political legal preview of its youth to keeping its comments focused on the more technical aspects of the law, at least to the extent that it is possible to avoid being political when discussing law. The amount of... (More)

The amount of laws that are subject to the legal preview has also changed over the years.
The changes to the position of the legal council can be attributed to both the advent of liberal democracy and the stances of the political parties that thrive in it. There is a clear division into political camps, where the Swedish right-wing has been in favor of keeping or expanding the power of the legal council, and the Swedish Social democrats wanting to limit it.
The Finnish legal preview is significantly weaker than the Swedish, at least in matters where the constitution is not relevant. (Less)
