Samvetsfrihet inom abortvården - En kritisk studie av samvetsfrihetens påverkan på tillgången till legal abort

Samvetsfrihet är en skyddad rättighet enligt Europakonventionen, men inte enligt svensk rätt vilket skapar en viss diskrepans i hur frågan handlas av domstolarna. Denna samvetsfrihet aktualiseras bland annat inom abortvården då vårdgivare av religiösa skäl inte vill delta i abortvård. Vidare finns en rätt till legal abort, lagstadgad i Sverige, men något otydligare i Europarätten. Denna rättighet behandlas av Europadomstolen främst inom ramen för rätt till adekvat sjukvård samt rätten till privatliv under Europakonventionen, medan den i Sverige behandlas under Abortlagen som är en del av lagstiftningen av sjukvården. Vidare rör processerna i svenska domstolar främst arbetsrättens frågor om arbetsledning för arbetsgivaren som motstående intresse, vilket inte sker i samma utsträckning i Europadomstolen. Uppsatsen syftar till att belysa denna intresseavvägningen och skillnaden i bedömningarna som görs i Sverige respektive Europa. Frågan innefattar två perspektiv, dels rätten till religionsutövning på arbetsplatsen, som är den rättighet som faktiskt aktualiseras i många fall. Dels rätten till adekvat sjukvård, vilken anses innefatta abortvård enligt domstolarna samt rätten för vårdgivarna att organisera arbetet för att leva upp till detta. Undersökningen har granskat gällande rätt och praxis utifrån frågeställningarna och kommit fram till att beviljad samvetsfrihet kan ha en negativ inverkan på tillgången till abort i landet. (Less)

The right to concentious objections is protected under the European convention, though not in Swedish national law, which creates a discrepancy in how the question is handled by the courts. Concentious objection is actualised in abortion care, when a care giver does not want to participate because of religious reason. Furthermore there is a legal right to abortions in Sweden, though somewhat more obscure under European law. This right is principally handled by the European court within the scope of the right to adequate healthcare and the right to private life under the European convention. The right to concentious objections is protected under the European convention, though not in Swedish national law, which creates a discrepancy in how the question is handled by the courts. Concentious objection is actualised in abortion care, when a care giver does not want to participate because of religious reason. Furthermore there is a legal right to abortions in Sweden, though somewhat more obscure under European law. This right is principally handled by the European court within the scope of the right to adequate healthcare and the right to private life under the European convention. In Swedish law it is instead handled under the abortion law which is part of the legislation of healthcare. This creates a conflict of interests between freedom of religion and the right to manifest religious beliefs, and the right to abortion. The process in Swedish court mainly concerns questions related to labor law with the interest of supervision of the work for the employer as opposing interest, which is not always reflected in the European courts judgements. The essay seeks to illustrate this balancing of interests and the difference in the assessments in Sweden and Europe respectively. The question entails two perspectives, partly that of the right to manifest one´s religion at the workplace, which is the right that is actualised in most cases. Partly that of the right to adequate healthcare, which includes abortion care according to the courts, and the right for employers to organise the work to live up to it. Established law and case law has been subject to the study and in accordance with the sub questions examined, from this the conclusion has been reached that the granting of concentious objections can have a negative impact on the access to abortions in the country.
