- I den svenska rätten kan vi i Föräldrabalkens kapitel 1 paragraf 1 utläsa följande: Är vid barns födelse modern gift med en man, ska denne anses som barnets far. Denna bestämmelse om faderskapspresumtion är gällande svensk rätt och huvudregel för hur faderskap i Sverige fastställs. Bestämmelsen härstammar från början från den romerska rätten och uttrycket ”pater est quem nuptiae demonstrant” som är latin för ”den är fader som äktenskapet utpekar”. Det har funnits diskussioner i riksdagen kring att förändra faderskapspresumtionen till att även omfatta sambor och det har även utretts om faderskapspresumtionen istället borde vara en föräldraskapspresumtion. Bestämmelsen härstammar från början ifrån att det var viktigt att veta om ett barn var fött inom eller utom ett äktenskapet på grund av dess starka samband med arvsrätten. Det finns dock inte längre något samband mellan faderskapspresumtionen och arvsrätten utan alla barn har idag samma rätt till arv. Att skaffa barn innan äktenskap eller att kanske inte ingå äktenskap alls är nuförtiden ett vanligt förekommande bland par och frågan som därmed uppkommer är huruvida regeln borde finnas kvar eller inte? Varför har riksdagen valt att behålla presumtionen? Finns det andra sätt, mer lämpliga för dagens samhälle, att fastställa faderskap på? (Less)

This provision of presumption of paternity is the primary rule for how paternity is decided in Sweden. This provision has its origins in Roman law and the Latin expression ”Pater est quem nuptiae demonstrant” translates to “The father is he whom the marriage points out”. There have been discussions in the Swedish parliament to extend the presumption of paternity to also include couples who live together in a shared household but are not married and it has furthermore been investigated if the presumption of paternity should instead be a presumption of parenthood. At every point, the Swedish parliament has decided to keep the presumption of paternity. When the law was first implemented it was important to know if a child was born within a marriage or not due to its role in inheritance but there is no longer any connection between the presumption of paternity and inheritance and these days all children have the same right to inheritance. To have children before marriage, or not entering into marriage at all, is a common occurence these days and the question arrises thus, should the rule remain or not? Why has the Swedish parliment chosen to keep the presumption of paterntity? Are there other ways to decide paternity, more suited for todays society? (Less)
