Falska toner bland rena motiv – en "intressekonflikt" mellan upphovsrätt, skyddstid och innovation

Teknikutvecklingens frammarsch har tillsammans med den kommersiella upphovsrättsmarknaden fått rättsområdet att utvecklas till något nytt – ett multinationellt ekonomiskt verktyg, som reglerar över ekonomisk tillväxt, ökad konkurrens, social sysselsättning och innovation. Teknikutvecklingen gjorde sig dock till en del av upphovsrätten långt innan lagstiftaren erkände eller insåg vidden av teknikens innebörd. Den nya rollen kommer dock med ett utökat visst ansvar, när verkningarna och konsekvenserna av utformningar, motiv och intressen plötsligt får förändringar för en global marknad.

Teknikutvecklingen gjorde sig dock till en del av upphovsrätten långt innan lagstiftaren erkände eller insåg vidden av teknikens innebörd. Den nya rollen kommer dock med ett utökat visst ansvar, när verkningarna och konsekvenserna av utformningar, motiv och intressen plötsligt får förändringar för en global marknad.

Detta rollspel mellan upphovsrätten och teknikutvecklingen kan beskrivas i termer av en progressiv dans, som i sin tur kan illustreras metaforen av ett brädspel; där tekniken bestämmer speltyp, konsumenterna spelar spelet och lagstiftaren ansvarar för att det inte uppstår några missförhållanden eller orättvisor mellan de olika pjäserna som ingår i spelet. Då och då ändrar tekniken speltyp, och nya regler behöver plötsligt uppfinnas, men innan det behöver lagstiftaren förstå vad som skiljer sig i det nya spelet och om alla som ingår i spelet får vara med på lika villkor. Annars riskerar lagstiftarens passivitet och tidigare instiftade regler att göra spelet orättvist. Plötsligt är det upp till lagstiftaren och domstolar att definiera identiteten av ett musikaliskt samtidigt som tekniken får konstformerna att utvecklas och en oförenlig avseende vad som identifierar musik uppstår.
Samtidigt som rättsområdet emellanåt behöver utvecklas inför teknikutvecklingens behöver det ännu oftare utvärderas. Upphovsrätten står idag för karaktärsmässiga svårigheter, med flexibla motiv som gör det svårt att utvärdera resultatet av utformningen. Den liberala flexibilitet avseende de motiv som lagen ämnar att tillvarata gör att den fortsatta rättsutvecklingen är svårläst.

De vaga och kompromissinriktade motiven har gjort den upphovsrättsliga skyddstiden till instrument som behagar ett kortsiktigt behov, utan att tillmäta den långtgående innebörden samma värde. Om detta beror på den tekniska utvecklingen, en högljudd marknad eller ett nytt upphovsrättsligt karaktärsdrag är svårt att säga. Alldeles oavsett är de upphovsrättsliga intressegrupperna just en del av ett och samma garnnystan hur krångligt och otydligt det än kan verka. (Less)

The advancement of technology development, together with the commercial
copyright market, has brought the legal area of copyright into something new – a multinational economic tool, that regulates economic growth, increased competition, social employment and innovation. However, technology development took part in copyright before the legislature acknowledged or realized the importance of the technology. The new role, however, comes with increased responsibility, when the effects and consequences of the legal motives and interests suddenly has an effect for a global market.

The advancement of technology development, together with the commercial
copyright market, has brought the legal area of copyright into something new – a multinational economic tool, that regulates economic growth, increased competition, social employment and innovation. However, technology development took part in copyright before the legislature acknowledged or realized the importance of the technology. The new role, however, comes with increased responsibility, when the effects and consequences of the legal motives and interests suddenly has an effect for a global market.

This role between copyright and technology development can be described in terms of a progressive dance, which in turn can be illustrated by the metaphor of a board game; where technology determines game type, onsumers play the game and the legislator is responsible for ensuring that there are no misunderstandings or inequalities between the various plays included in the game. From time to time, technology changes game type, and new rules need to be invented in order for the players to participate on equal terms, but before the new rules can apply the legislator needs to figure out and understand the difference in the new game. Otherwise, the legislator's passivity and previously established rules risk's making the game unfair. And suddenly, it is up to the legislator and courts to define the identity of a musical performance at the same time as the technology makes the art forms evolve. The two-way development increases the risk for an incompatible interpretation regarding the definition of music to occur.

At the same time as the legal area needs to be developed in advance of
technology development, it needs to be evaluated even more often. Copyright now stands for characteristic difficulties, with flexible motives that make it difficult to evaluate the outcome of the legal design. The liberal function and flexibility, regarding the motives
which the law intends to make, makes the continued legal development difficult to foresee.

The vague and compromise friendly motives have made the copyright term to an instrument that satisfy a short-term need, without attributing the far-reaching meaning to the same value. If this is due to technical developments, a loud market or a new copyright feature, it's hard to say. Right now the different motives and interests are part of one and the same yarn star, how difficult and unclear it may seem. (Less)
