Dispositionsprincipen är en av de grundläggande principerna inom den svenska civilprocessen. Principen stadgas i 17 kap. 3 § i den svenska rättegångsbalken där det framgår att domstolen inte får meddela dom över "annat eller mera än vad part i behörig ordning yrkat" samt att domstolen i dispositiva mål inte får ta hänsyn till omständigheter som inte åberopats av en part till grund för hans eller hennes talan.

Syftet med denna uppsats är att granska hur dispositionsprincipen påverkar möjligheterna att nyttja rättssystemet och att granska om dispositionsprincipen fyller den funktion som den avses fylla inom det svenska rättssystemet eller inte.

Dispositionsprincipen är en av de grundläggande principerna inom den svenska civilprocessen. Principen stadgas i 17 kap. 3 § i den svenska rättegångsbalken där det framgår att domstolen inte får meddela dom över "annat eller mera än vad part i behörig ordning yrkat" samt att domstolen i dispositiva mål inte får ta hänsyn till omständigheter som inte åberopats av en part till grund för hans eller hennes talan.

Syftet med denna uppsats är att granska hur dispositionsprincipen påverkar möjligheterna att nyttja rättssystemet och att granska om dispositionsprincipen fyller den funktion som den avses fylla inom det svenska rättssystemet eller inte.

Uppsatsen är indelad i sex kapitel. Det första kapitlet är en introduktion till uppsatsen och behandlar syftet med framställningen, den metod och det material som används och de avgränsningar som gjorts. Därefter följer en kort bakgrund där dispositionsprincipen presenteras och en relativt utförlig redogörelse för det teoretiska ramverk som resonemangen i uppsatsen utgår från. Det teoretiska ramverket består av en av vår tids största sociologer Pierre Pierre Bourdieus teorier och koncept. De koncept som används i uppsatsen är habitus, fält, kapital och doxa. I det nästföljande kapitlet redogörs för hur dispositionsprincipen tillämpas inom det svenska rättssystemet och hur dispositionsprincipen påverkar människors möjligheter att nyttja rättssystemet. Det konstateras att dispositionsprincipen innebär att personer som saknar kulturellt och ekonomiskt kapital har små möjligheter att nyttja rättssystemet. I kapitel fem granskas om dispositionsprincipen fyller den funktion som den avses fylla inom det svenska rättssystemet eller inte. Det slås fast att dispositionsprincipen inte fullt ut kan anses fylla den funktion som den avses fylla.


I uppsatsens avslutande kapitel reflekteras kring varför gällande rätt ser ut som den gör och vilka förändringar inom rättssystemet som skulle kunna medföra att personer som saknar kulturellt och ekonomiskt kapital ges bättre möjligheter att tillvarata sina rättigheter inom ramen för rättssystemet. The principle of party disposition is a fundamental principle in Swedish civil procedure. The principle is stated in the 3rd paragraph of the 17th chapter in the Swedish Code of Judicial Procedure where it is stated that “judgment may not be given for something else or more than that properly demanded by a party” and that judgment, “[i]n cases amenable to out-of-court settlement […] may not be based on circumstances other than those pleaded by a party as the foundation of his action.”

The purpose of this thesis is to analyse in what way the principle of party disposition affects access to justice, and to analyse whether the principle of party disposition fulfills the function it is argued to fulfill within the justice system.

The principle of party disposition is a fundamental principle in Swedish civil procedure. The principle is stated in the 3rd paragraph of the 17th chapter in the Swedish Code of Judicial Procedure where it is stated that “judgment may not be given for something else or more than that properly demanded by a party” and that judgment, “[i]n cases amenable to out-of-court settlement […] may not be based on circumstances other than those pleaded by a party as the foundation of his action.”

The purpose of this thesis is to analyse in what way the principle of party disposition affects access to justice, and to analyse whether the principle of party disposition fulfills the function it is argued to fulfill within the justice system.

The thesis is divided into six chapters. The first chapter consists of an introduction to the essay in which the purpose, the method, the material and the delimitations are provided for. The second chapter consists of a brief background in which the principle of party disposition is presented. Thereafter follows a relatively extensive account for the theoretical framework used in the essay. The theoretical framework consists of the sociological theories and concepts developed by Pierre Bourdieu, one of our time’s greatest sociologists. The concepts used in the essay are habitus, field, capital and doxa. In the fourth chapter the way in which the principle of party disposition is applied within the Swedish justice system and the way in which the principle affects individuals access to justice is provided for. It is established that the principle of party disposition weakens certain individuals’ access to justice as sufficient cultural or economical capital is necessary in order for an individual to be able to successfully take legal action on his or her own.

In the fifth chapter it is analysed whether the principle of party disposition fulfills the function it is argued to fulfill within the justice system. It is established that the principle can only partly be said to fulfill the function it is argued to fulfill.

In the final chapter of the thesis I reflect on why the current legislation is structured as it is and I discuss which reforms could be made in order to give people with insufficient cultural and economic capital better opportunities to access justice. Suggestions for future studies are also provided. (Less)
