Abstract (Swedish)
Sedan länge har det funnits en uppdelning i Sverige mellan den idrottsliga världen och den allmänna domstolen när det kommer till idrottsrelaterad tvistelösning. Denna uppdelning innebär i praktiken att idrottsnämnder sköter sin egen tvistelösning genom privatdomarförfaranden och i vissa fall skiljeförfaranden. Denna uppsats undersöker Svensk Travsports privatdomarförfarande och jämför det med artikel 6.1 om rätten till en rättvis rättegång enligt Europeiska konventionen om skydd för de mänskliga rättigheterna och de grundläggande friheterna. Syftet är att undersöka huruvida konventionen är tillämplig på förfarandet eller inte och huruvida kriterierna uppställda i artikel 6.1 efterlevs inom privatdomarförfarandet.

Denna uppsats undersöker Svensk Travsports privatdomarförfarande och jämför det med artikel 6.1 om rätten till en rättvis rättegång enligt Europeiska konventionen om skydd för de mänskliga rättigheterna och de grundläggande friheterna. Min slutsats är att konventionen inte kan anses vara tillämplig på travsportens tvistelösningsförfarande. Detta då det är ett icke-lagstadgat avtalsbaserat förfarande, vars beslut inte går att verkställa. Domen får således inte de rättsverkningar som bl.a. krävs för att konventionen ska anses vara tillämplig. Även om förfarandet inte går under konventionen efterlevs vissa av principerna i EKMR ändå, men långt ifrån alla. På grund av förfarandets privata karaktär är det dessutom svårt att undersöka i vilken grad kriterierna faktiskt efterföljs. (Less)

In practice this division means that sports associations deal with their disputes through private dispute resolution and in some cases through arbitration proceedings. This essay examines the Swedish Trotting Associations private dispute resolution and compares it with article 6.1 regarding the right to a fair trial in the Convention for the Protection of Human Rights and Fundamental Freedoms. For a long time, there has been a division in Sweden between the sports movement and the general courts when it comes to sports-related disputes. In practice this division means that sports associations deal with their disputes through private dispute resolution and in some cases through arbitration proceedings. This essay examines the Swedish Trotting Associations private dispute resolution and compares it with article 6.1 regarding the right to a fair trial in the Convention for the Protection of Human Rights and Fundamental Freedoms. The purpose is to examine whether the convention applies to the proceeding or not and whether the criteria in article 6.1 are complied with within the private dispute resolution.
My conclusion is that the convention is not applicable to the private dispute resolutions within the Swedish Trotting Association. The reason for this is that the proceedings are not regulated in law but through contracts, hence the judgment can not be executed. Therefore, the verdict does not carry the legal effect which, inter alia, is required of a judicial decision for the convention to be considered applicable. Although the convention is not applicable to the procedure, some of the principles of the convention are still respected, but far from all. Moreover, due to the private nature of the procedures, it is difficult to investigate to what extent the criteria are actually followed. (Less)
