- Uppsatsen syftar till att undersöka i vilken utsträckning en arbetsgivare kan bestämma vad en arbetstagare ska ha på sig på arbetsplatsen utan att inskränka på den anställdas skydd mot att bli diskriminerad. Fokus ligger på att bena ut vad som ryms under begreppet arbetsledningsrätt när det gäller arbetstagarens utseende på jobbet samt vilka begränsningar som finns i denna fråga. En vinkel som undersöks handlar om hur krav från arbetsgivaren i fråga om klädsel och utseende på jobbet kan betraktas ur ett könsperspektiv och diskussion förs kring var gränsen går innan skilda bestämmelser för de olika könen innebär könsdiskriminering.

För att nå vår slutsats har gällande rätt sammanfattats genom beaktning av de traditionella rättskällorna såsom lag, förarbeten, doktrin, sedvänja och rättspraxis i form av såväl nationella som internationella rättsfall. Efter undersökning av rättsläget dras slutsatsen att motivet bakom arbetsgivarens klädpolicy har stor betydelse för om bestämmelsen hamnar inom arbetsledningsrätten eller inte. Likaså dras slutsatsen att olika utseendekrav kan ställas på män och kvinnor utan att det kommer i konflikt med diskrimineringslagen om arbetsgivaren har ett berättigat syfte. Ett huvudinstrument i en sådan bedömning är att göra en intresseavvägning mellan arbetsgivarens syfte och arbetstagarens motiv att inte följa en klädpolicy. (Less) - Abstract
- The aim of this essay is to investigate the extent to which employers can decide what employees wear at work before restricting the employee's right not to be discriminated. The main focus lies in figuring out what the term managerial prerogative entails when it comes to the employee’s appearance at work including the juridical limitations in this question. One angle of the matter is considering how demands from the employer when it comes to dress code requirements and other appearance at work can be viewed in a gender perspective and a discussion is held about whether or not unequal requirements for men and women imply gender discrimination.
In order to reach a conclusion the applicable law has been summarized by examining the... (More) - The aim of this essay is to investigate the extent to which employers can decide what employees wear at work before restricting the employee's right not to be discriminated. The main focus lies in figuring out what the term managerial prerogative entails when it comes to the employee’s appearance at work including the juridical limitations in this question. One angle of the matter is considering how demands from the employer when it comes to dress code requirements and other appearance at work can be viewed in a gender perspective and a discussion is held about whether or not unequal requirements for men and women imply gender discrimination.
In order to reach a conclusion the applicable law has been summarized by examining the traditional source of law like statutory law, preparatory law, doctrine, general custom and case law both from national and international courts. After studying the applicable law the conclusion can be made that the motive behind the employers dress code is of high importance when deciding whether or not the regulation falls within the managerial prerogative or not. Also the conclusion is made that different demands of appearance for men and women can be made without conflicting with discrimination law as long as the employer has a justified purpose. One main instrument in the assessment is to make a proponality balance between the employers legitimate aim of the rule and the employees personal purpose not to follow the dress-policy. (Less)
