Ett barn med funktionsnedsättning kan ansöka om bistånd för att avlasta föräldrarna i vårdnadsansvaret. Vid bedömning om bistånd ska beviljas eller inte, ska beslutsfattaren bedöma föräldraansvarets omfattning. Föräldraansvaret är ett begrepp som syftar till att jämföra det ansvar en förälder till ett barn med funktionsnedsättning har och det ansvar en förälder till ett barn utan funktionsnedsättning har. Föräldraansvaret utgår ifrån 6 kap. 2 § FB som stadgar att varje barn har rätt till trygghet, omvårdnad och en god uppfostran. En förälder till ett barn med funktionsnedsättning har således samma ansvar att tillgodose sitt barns behov som en förälder till ett barn utan funktionsnedsättning i motsvarande ålder. Samtidigt har socialtjänsten ett ansvar att verka för att alla barn växer upp under trygga och goda förhållanden och att barn och vuxna med funktionsnedsättning får möjlighet att leva som andra.

Syftet med uppsatsen är att undersöka gränsdragningen mellan socialtjänstens ansvar över barn med funktionsnedsättning och föräldraansvaret för ett barn med funktionsnedsättning. Vidare kommer uppsatsen att undersöka hur de olika kvalitetsbegreppen inom SoL och LSS, det vill säga skälig levnadsnivå respektive goda levnadsvillkor, påverkar socialtjänstens ansvar och föräldraansvarets omfattning utifrån två insatser från vardera lag. Insatserna är avlösning i hemmet enligt SoL och avlösarservice i hemmet enligt LSS. Motivet till de valda insatserna är att de är en av de vanligaste insatserna för barn under 18 år och att de i sin natur riktar sig till anhöriga.

För att uppfylla syftet kommer uppsatsen att bestå av två delar, dels en deskriptiv del av gällande rätt, dels en empirisk studie av rättsfall. Metoderna som kommer att användas är den rättsdogmatiska metoden och den rättsanalytiska metoden.


Uppsatsen kommer att använda sig av dels ett rättssäkerhetsperspektiv, dels ett anhörigperspektiv. Rättssäkerhetsperspektivet tar sikte på de olika begreppen som finns i respektive lag för att uppfylla de utsatta mål som finns stadgade i lagarna. Anhörigperspektivet kommer att användas vid dels undersökning av de valda insatserna, dels vid den empiriska undersökningen. Den empiriska undersökningen har granskat 40 st rättsfall från förvaltningsdomstolarna i Sverige. 20 st rättsfall berör avlösning i hemmet enligt SoL medan resterande 20 berör avlösarservice i hemmet enligt LSS. Vid den empiriska undersökningen har en metod använts för att kunna göra en enhetlig granskning av rättsfallen.

Slutsatsen utifrån den deskriptiva delen är att föräldraansvaret har en större omfattning vid sökt bistånd enligt SoL än vid sökt bistånd enligt LSS. Det är enligt min åsikt att utifrån det målorienterade syftet i SoL, begreppet ”skälig levnadsnivå” som är en miniminivå på insatsen och det faktum att lagen bedömer familjen som en enhet att större ansvar läggs över på föräldrarna för att tillgodose barnets behov.

Å andra sidan är slutsatsen utifrån den empiriska undersökningen att det inte går att se någon skillnad i förvaltningsdomstolarnas bedömning av föräldraansvaret utifrån SoL och LSS. Det framgår inte heller hur rätten har gjort sin bedömning av föräldraansvaret eller vad rätten har utgått ifrån när de har gjort en jämförelse mellan barnet som har ansökt om insatser och ett barn i motsvarande ålder.
De båda resultaten är både motsägelsefulla och skapar en rättsosäkerhet. (Less)

Parental responsibility is a legal concept which aims to compare a parent’s responsibility to their functional impaired child to a parent’s responsibility for a functional unimpaired child of a corresponding age. The parental responsibility derives from the 6th chapter 2nd § Children and Parents Code (1949:381) (FB), which concludes that every child has a legal right to safety, care and a good nurture. A parent to a functional impaired child has the same responsibility to provide for their child’s need as a parent to a functional unimpaired child of a corresponding age. The social welfare board has, at the same time, a responsibility to ensure all children grow up under safe and good circumstances and that all children and adults with functional impairments attain the same possibilities as everyone else to live an adequate life.

The purpose of this essay is to investigate the demarcation between the responsibility of the social welfare board and the parental responsibility for a functional impaired child. Furthermore, this essay will investigate the two different definitions of quality of the social assistance in SoL and LSS, i.e. a reasonable standard of living and good living conditions, and how they impact the responsibility of social services and the parental responsibility. The social assistance chosen is relief service in the home. This particular social assistance exists in both SoL and LSS. The motive of the chosen social assistances is that they are one of the most common social assistances for children under the age of 18 and they are in inherently aimed to relieve parents of their responsibility of care.


In order to fulfill the purpose of the essay, it will consist of two parts: The first, a descriptive section which aims to settle the meaning of the established law; the second, an empirical study of relevant cases. The legal dogmatic and legal analysis methods will be used.

The essay will use both the perspective of the rule of law and the perspective of the close relative. The empirical study of cases examines 40 different cases from the administration courts in Sweden. Twenty of the cases are related to the relief service in home from SoL, while the other twenty cases are related to the relief service in home from LSS. During the empirical study different question formulations will be used in order to receive as unified a result as possible.
The conclusion from the descriptive section is that the parental responsibility when applying for social assistance in SoL has a larger scope than the parental responsibility in LSS. In my opinion, the results derive from the goal-oriented purpose of SoL, the definition of reasonable standard of living, and that the whole family seems to be the target of the social assistance. By making the whole family the subject of the social assistance, a bigger responsibility is relied upon the parents to see to their child’s need.

On the other hand, the conclusion from the empirical study of cases is that there is no difference in the parental responsibility regarding the two laws. It was not possible to see any difference from the assessment of the parental responsibility deriving from SoL or LSS. Furthermore, it is not possible to see how the administration courts have assessed the parental responsibility nor what material the courts have used when comparing the needs of a functionally impaired child with a functionally unimpaired child. The results are inconclusive and shows an uncertainty for the individual to be able to predict the outcome of their case. (Less)
