"Lagrådet har en annan uppfattning än regeringen" - En kritisk analys av Lagrådets granskningsverksamhet med utgångspunkt i 8 kap 22 § RF

Under senare år har Lagrådets kritik uppmärksammats alltmer och de senaste granskningarna indikerar att det har skett en ökning av kritik mellan åren 2017–2018. Inom ramen för den här uppsatsen görs en analys av Lagrådets kritik mellan åren 2010–2018. Studiens syfte är att analysera lagrådskritik under perioden och varför denna har ökat. Syftet är också att analysera skäl som talar för respektive emot att Lagrådet ska få ett större inflytande i lagstiftningsprocessen och vilka konsekvenser detta skulle kunna få. Frågeställningarna lyder: Vilka möjliga förklaringar går att finna till den ökning som har skett? Inom ramen för den här uppsatsen görs en analys av Lagrådets kritik mellan åren 2010–2018. Studiens syfte är att analysera lagrådskritik under perioden och varför denna har ökat. Syftet är också att analysera skäl som talar för respektive emot att Lagrådet ska få ett större inflytande i lagstiftningsprocessen och vilka konsekvenser detta skulle kunna få. Frågeställningarna lyder: Vilka möjliga förklaringar går att finna till den ökning som har skett? Samt vad talar för respektive emot att Lagrådet ska ges större inflytande i lagstiftningsprocessen än det som föreskrivs i 8 kap 22 § regeringsformen (1974:152)?

I studien används rättsdogmatisk metod och rättssociologisk metod. Den rättssociologisk metoden inkluderar en empirisk undersökning med en kvantitativ metod och en kvalitativ metod. Materialet består av statliga utredningar och propositioner, juridiska artiklar, samt yttranden från Lagrådet. Resultatet visar dels att ökningen beror på att lagstiftningsaktiviteten generellt har ökat under 2015–2018, dels att en ökning förefaller ske mera specifik i slutet av en mandatperiod oavsett regering. Det är däremot svårt att belägga att lagförslagens kvalité skulle ha minskat 2015–2018.

Vad som talar för respektive emot att Lagrådet ges ytterligare inflytande beror på vilken syn man har på vad som är Lagrådets funktion. Om man ser Lagrådet som en normkontrollverksamhet, finns det fler skäl som talar för att Lagrådet inte ska ges större inflytande. Om man däremot ser Lagrådet som en del i lagstiftningsprocessen talar mer för att Lagrådet ska få större inflytande. (Less)
Abstract
In recent years, criticism from the Council on Legislation has been given more attention and studies indicate that there has been an increase of criticism in 2017–2018. The aim of this study is to analyze the criticism from the Council on Legislation against bills during the period 2010–2018 and why it has increased. The purpose is also to analyze reasons for and against that the Council on Legislation should have more influence in the legislative process and what consequences this might have. In recent years, criticism from the Council on Legislation has been given more attention and studies indicate that there has been an increase of criticism in 2017–2018. The aim of this study is to analyze the criticism from the Council on Legislation against bills during the period 2010–2018 and why it has increased. The purpose is also to analyze reasons for and against that the Council on Legislation should have more influence in the legislative process and what consequences this might have. The research questions are: Which possible explanations can be given for the increase? Which are the arguments for and against that the Council on Legislation should be given greater influence in the legislative process than what is stipulated in The Instrument of Government (1974:152) Chapter 8, Section 22?

The study uses legal method and sociology of law method. The sociology of law method includes an empirical study with both quantitative and qualitative methods. The study is based on legislative history, legal articles, and proposal referred to the Council on Legislation for consideration. The empirical study shows that the increase is a consequence of an increased legislative activity in general during 2015–2018. Furthermore, the legislative activity appears to increase more specifically at the end of a term regardless of administration.

The result from the second study, shows that the answer to the question about reasons for and against greater influence in the legislative process depends on how you consider the Council on Legislation's function. If one looks upon the Council on Legislation as an organ with a norm control function, there are more reasons that indicate that the Council on Legislation should not be given greater influence. If, on the other hand, you consider the Council on Legislation to be a part of the legislative process, then more speaks in favour of the Council on Legislation to have greater influence. (Less)
