Skrämda vittnen - något nytt? - En analys av argumentationen och betydelsen av vittnens utsatthet i debatten om anonyma vittnen

Förslaget om att införa anonyma vittnen i Sverige har fått större medialt utrymme på senaste tiden. En anledning är den grova gängkriminaliteten, och utsattheten hos vittnen, som av många antas vara ett resultat av den. Några debattörer uppger eller antyder att de tidigare motsatt sig tanken om anonyma vittnen men att den nya situationen med gängkriminaliteten har ändrat deras uppfattning.

Uppsatsen belyser och analyserar de huvudsakliga argument som framförts i den offentliga debatten om förslaget om anonyma vittnen. Genom att undersöka argumentens hållbarhet tydliggörs samtidigt vilka omständigheter som talar för respektive mot anonyma vittnen. Förslaget om att införa anonyma vittnen i Sverige har fått större medialt utrymme på senaste tiden. En anledning är den grova gängkriminaliteten, och utsattheten hos vittnen, som av många antas vara ett resultat av den. Några debattörer uppger eller antyder att de tidigare motsatt sig tanken om anonyma vittnen men att den nya situationen med gängkriminaliteten har ändrat deras uppfattning.

Uppsatsen belyser och analyserar de huvudsakliga argument som framförts i den offentliga debatten om förslaget om anonyma vittnen. Genom att undersöka argumentens hållbarhet tydliggörs samtidigt vilka omständigheter som talar för respektive mot anonyma vittnen. Uppsatsen undersöker också huruvida det finns stöd i argumentationen för antagandet att en högre utsatthet hos vittnen skulle tala för att införa ett system med anonyma vittnen.

Undersökningen visar att många av de argument som framförts i debatten saknar betydelse för frågan om anonyma vittnen borde införas. Undersökningen visar också att det endast finns ett ytterst svagt stöd, om ens något, i argumentationen, för antagandet att en större utsatthet hos vittnen skulle tala för ett införande av anonyma vittnen. Det eventuella stödet återfinns inte bland argumenten som gjorts gällande av de debattörer som verkar ha ändrat åsikt på grund av gängkriminaliteten, utan istället bland de argument som är ämnade att tala mot ett införande. The idea of a system which would allow anonymous witnesses in Sweden has received increasing media attention recently. One of the reasons is the serious gang criminality, and the threat to witnesses, which by many is assumed to be a result of that. Some of the debaters state or imply that they previously were opposed to the idea of anonymous witnesses but that the new situation with the gang criminality has changed their view.

The thesis highlights and analyses the main arguments which have been presented in the public debate regarding the idea of anonymous witnesses. The idea of a system which would allow anonymous witnesses in Sweden has received increasing media attention recently. One of the reasons is the serious gang criminality, and the threat to witnesses, which by many is assumed to be a result of that. Some of the debaters state or imply that they previously were opposed to the idea of anonymous witnesses but that the new situation with the gang criminality has changed their view.

The thesis highlights and analyses the main arguments which have been presented in the public debate regarding the idea of anonymous witnesses. The thesis also examines whether there is a bases in the argumentation for the view that an increased threat against witnesses would favor the idea of anonymous witnesses.

The research shows that a lot of the arguments put forward in the debate lacks significance for the question of whether anonymous witnesses should be implemented. The research also shows that there is only a very weak bases, if any, in the argumentation, for the assumption that an increased threat to witnesses would favor an implementation of anonymous witnesses. The possible bases is not found in the argumentation presented by those debaters who appear to have change their stand point because of the gang criminality, but amongst the arguments which were meant to oppose an implementation.
