- I denna uppsats undersöks gällande rätt och inskränkningar beträffande rätten att inneha bisysslor genom den svenska arbetsrättslagstiftningen, kollektivavtalen samt arbetsdomstolens rättstillämpning. Här analyseras domstolens rättsliga överväganden och syftet med reglerna. Utgångspunkten för analysen är de formulerade rättsliga frågeställningar. Den metod som har använts vid författandet av uppsatsen baseras på den traditionella rättsdogmatiska metoden som lägger fokus på centrala och auktoritativa rättskällor inom nationell rätt.

Resultaten visar att en bisyssla kan vara tillåten eller otillåten och en och samma bisyssla kan vara både förtroendeskadlig, arbetshindrande och konkurrerande med arbetsgivaren. Det finns en generell uppdelning där bisysslor som kan rubba förtroendet eller skada myndighetens anseende är förbjudna enligt lag, och övriga förbud mot bisysslor regleras i avtal. Detta innebär att arbetsgivaren med lagstöd kan förbjuda arbetstagaren att ha bisysslor som anses förtroendeskadliga, arbetshindrande eller konkurrerande bisysslor kan förbjudas enligt kollektivavtal. Huvudsyftet med bisyssloförbudet i lag baseras på kravet att offentligt anställda inte får skada allmänhetens förtroende för verksamheten. Detta ställningstagande kan ses mot ljuset av Regeringsformen som stadgar att begränsningar i rätten att driva näring eller utöva yrke får endast införas för att skydda angelägna allmänna intressen. Förbudet mot arbetshindrande bisysslor och konkurrensbisysslor ämnar skydda olika arbetsgivarintressen. Syftet med reformen 2002 var att anlägga en kontrollfunktion på arbetsgivarna. Sammanfattningsvis anser jag att de regler som finns idag ger arbetsgivaren utrymme att agera för att motverka otillåtna sysslor, och att frågan är en del utav arbetsledningsrätten. Däremot är regelbeståndet svåröverskådligt. Det finns således skäl att utvärdera reglerna om kontroll som trädde i kraft år 2002. (Less) - Abstract
- The aim of this paper is to examine current laws and restrictions regarding the right to hold secondary employment through Swedish labor law, Swedish collective agreements and through the Labor Court’s legal application. The paper analyzes the court’s legal considerations and the purpose of the laws and restrictions. The starting point for the analysis is the legal issues.
The method used in the paper is based on the traditional legal dogmatic method, which focuses on central and authoritative sources of law within the legal system.

The paper analyzes the court’s legal considerations and the purpose of the laws and restrictions. The starting point for the analysis is the legal issues.
The method used in the paper is based on the traditional legal dogmatic method, which focuses on central and authoritative sources of law within the legal system.
The research has showed that a secondary employment can be allowed or unauthorized. There is a general sectioning where the secondary occupations can disturbe the trust or damage the authority’s reputation are prohibited by law and other prohibitions are regulated in agreements. The purpose of the reform that took place in 2002 was to impose a control function on employers. This means that the employer, with legal support, can prohibit the employee from having secondary employment that are considered illicit, relative to 7 § LOA. The main purpose of the statutory rules is based on the requirement that public employees must not damage the public's confidence in the authority. This position can be seen in the light of the Constitution of Sweden (Regeringsformen), as statutes that restrictions on the right to practice or practice a profession may only be imposed in order to protect urgent public interests. Other prohibitions intend to protect various employers' interests. In short, the conclusions of the thesis are that the rules that exist give the employer room to act to counteract unauthorized activities, and that the issue is part of the work management law. However, it is difficult to get a holistic approach about the rules. There are also reasons to evaluate the control rules that came into force in 2002. (Less)
