- Den här kandidatuppsatsen är en komparativ undersökning av Sveriges och Danmarks utvisningsförfaranden rörande utländska medborgare som anses utgöra ett kvalificerat hot mot statens säkerhet. Ländernas utvisningsförfaranden präglas av sekretess och de rättssäkerhetsgarantier som karaktäriserar ett straffrättsligt förfarande är inte tillämpliga. Uppsatsens syfte är att undersöka de båda utvisningsförfarandenas likheter och skillnader i relation till instansordning, utredningsansvar och den enskildes rätt till partsinsyn. Uppsatsen gör även en kortfattad undersökning av Europakonventionens krav på effektiva rättsmedel vid utvisningsärenden som rör statens säkerhet.

Ländernas utvisningsförfaranden präglas av sekretess och de rättssäkerhetsgarantier som karaktäriserar ett straffrättsligt förfarande är inte tillämpliga. Sverige och Danmark har två olika strategier för att kompensera för den inskränkta partsinsynen. I Sverige får den enskilde och dess juridiska biträde en sammanfattning av de skäl som ligger till grund för ett eventuellt utvisningsbeslut. I Danmark tillgodoses partsinsynen genom att en specialadvokat får ta del av sekretessbelagt material som den enskilde inte har tillgång till. Vid ett överklagande i Danmark hanteras ärendet enligt ett särskilt domstolsförfarande inspirerat av Storbritannien. I Sverige förekommer ingen domstolsprövning av utvisningsfrågan efter Migrationsverkets beslut i första instans. Istället är det regeringen som fattar beslut i utvisningsfrågan som andra instans efter ett bindande yttrande av Migrationsöverdomstolen rörande eventuella verkställighetshinder.
Uppsatsen konstaterar att konstruktionen av Danmarks utvisningsförfarande möjliggör att den enskilde kan få tillgång till mer partsinsyn. (Less) - Abstract
- This bachelor’s thesis is a comparative study of Sweden’s and Denmark’s administrative expulsion proceedings of aliens who are considered to be a qualified threat to the national security. The expulsion proceedings are characterized by confidentiality; and procedural safeguards associated with a criminal procedure are not applicable. The purpose of this thesis is to examine the expulsion proceedings' similarities and differences regarding the court hierarchy, the responsibility to investigate, and the party’s right to insight. The thesis also provides a brief overview of the European Convention’s requirements for effective remedies in expulsion cases involving national security.

(More) - This bachelor’s thesis is a comparative study of Sweden’s and Denmark’s administrative expulsion proceedings of aliens who are considered to be a qualified threat to the national security. The expulsion proceedings are characterized by confidentiality; and procedural safeguards associated with a criminal procedure are not applicable. The purpose of this thesis is to examine the expulsion proceedings' similarities and differences regarding the court hierarchy, the responsibility to investigate, and the party’s right to insight. The thesis also provides a brief overview of the European Convention’s requirements for effective remedies in expulsion cases involving national security.
Sweden and Denmark have two different strategies to compensate for the restricted party insight. In Sweden, the alien and their legal counsel receive a summary of the expulsion grounds. In Denmark, the alien is represented by a special advocate with full insight in the confidential material. Material which the alien does not have access to. In case of an appeal in Denmark, the case is processed in a special court which is inspired by the United Kingdom. In Sweden, there are no judicial proceedings in court regarding the matter of expulsion after the Swedish Migration Agency first decision. Instead, the Government decides in the expulsion matter after obtaining a binding opinion from the Migration Court of Appeal, regarding impediments to enforcement.
The thesis concludes that the construction of Denmark’s expulsion proceedings can enable more party insight to the individual. (Less)
