Grov kvinnofridskränkning – ett resultat av fenomenet symbollagstiftning?

Regeringen ansåg att införandet av ett kvinnofridsbrott var en viktig åtgärd för att belysa det våld som kvinnor utsätts för i hemmen och för att höja straffvärdet för den här gärningstypen. Regeringen ämnade genom kriminalisering att markera allvaret i systematiska övergrepp, brott samt kränkningar som begås av en nuvarande eller tidigare partner. Därtill hade regeringen för avsikt att stärka det straffrättsliga skyddet för kvinnor som utsätts för den här typen av upprepad brottslighet i nära relationer. Regleringens övergripande syfte kan därmed sägas vara att bekämpa våldet mot kvinnor.

Regeringen ämnade genom kriminalisering att markera allvaret i systematiska övergrepp, brott samt kränkningar som begås av en nuvarande eller tidigare partner. Därtill hade regeringen för avsikt att stärka det straffrättsliga skyddet för kvinnor som utsätts för den här typen av upprepad brottslighet i nära relationer. Regleringens övergripande syfte kan därmed sägas vara att bekämpa våldet mot kvinnor.

Statistik från Brottsförebyggande rådet visar likväl på att såväl antalet anmälningar, personuppklaringar och lagföringar avseende brottet grov kvinnofridskränkning minskade under åren 2009–2019.

Kriterierna för kriminalisering inom svensk straffrätt utgör en utgångspunkt för utredningen. Syftet är att undersöka hur brottet grov kvinnofridskränkning förhåller sig till de här kriterierna. Utredningen fokuserar på kravet på ett godtagbart skyddsintresse jämte kravet på effektivitet. Det sistnämnda kravet kan delas upp in i en traditionell och en modern tolkning.

Straffrättslig symbollagstiftning är ett fenomen som knyter an till begreppet effektivitet. Symbolisk lagstiftning kan definieras som lagstiftning vilken utger sig för att presentera lösningen på ett utpekat problem, medan dess verkliga syfte är dolt. Dess verkliga syfte är enligt den straffrättsliga litteraturen att tillgodose politiska behov. Det ska betonas att den symboliska lagstiftningen är en effekt av den ökade politiseringen som skett inom straffrätten.

Uppsatsförfattarens slutsats är att brottet grov kvinnofridskränkning inte lyckas skydda kvinnor från systematiska övergrepp i förhållanden. Vidare kan konstateras att det aktuella brottet inte uppfyller samtliga kriterier för kriminalisering. Slutligen kan uppmärksammas att kvinnofridsbrottet är att bedöma som lagstiftning med högt symbolvärde, vilket är att betrakta som oönskat enligt den defensiva straffrättspolitiken såväl som den offensiva straffrättspolitiken. Abstract
The implementation of the crime, gross violation of a women’s integrity was considered to be an important measure to illustrate the violence that women are exposed to in domestic environments and to raise the penal-value for those acts. The government’s intention with the criminalization was to put a mark on the severity of systematic abuse, offence, and infringement that are perpetrated by a current or earlier partner. Thereto the government intended to strengthen the penal protection for women that are exposed to these types of repetitive acts of violence in close relationships. It is therefore considered that the overall purpose is to combat violence against women.

The implementation of the crime, gross violation of a women’s integrity was considered to be an important measure to illustrate the violence that women are exposed to in domestic environments and to raise the penal-value for those acts. The government’s intention with the criminalization was to put a mark on the severity of systematic abuse, offence, and infringement that are perpetrated by a current or earlier partner. Thereto the government intended to strengthen the penal protection for women that are exposed to these types of repetitive acts of violence in close relationships. It is therefore considered that the overall purpose is to combat violence against women.

Nonetheless, statistics from the Swedish National Council for Crime Prevention display a decrease over the last ten years in the amount of cases reported, as well as cases in which legal proceedings were taken against the offender.

The criteria for criminalization that are within Swedish penal law are to be seen as a starting point for the investigation at hand. The purpose is to examine how the crime gross violation of a woman’s integrity relates to these criteria. The investigation has a clear focus on the requirements for an acceptable protection of interest as well as the requirement on efficiency. The latter can be divided into a traditional and modern interpretation.

Symbolic criminal legislation is a phenomenon that connects to the concept of efficiency. It is best defined as legislation, which purports to aim at a problem and present a solution to it, although its true purpose is hidden. According to literature within the subject its true purpose is to meet political needs. It should be emphasized that the symbolic criminal legislation is an outcome of the increased politicization that has occurred within penal law.

The conclusions from the investigation shows that the crime gross violation of a woman’s integrity fails to protect women from systematic violence in relationships. It can be concluded that the just mentioned crime does not does not satisfy the requirements for criminalization. Lastly, it can be observed that the crime in mention is considered legislation with high symbolic value. This is frowned upon by the defensive as well as offensive criminal justice policies. (Less)
