- Abstract
- The aim of this study was to create an understanding how verdicts in the Swedish appeal court describes the best interest of the child, child’s will and the risks around children when theres is a parent with addiction problems. This study was based on a qualitative content analysis of twelve verdict from the appeal court. The verdicts did not have any geographical boundaries and the verdicts were published from year 2010 to 2019. Social constructionism and Michel Foucault power perspective were used to analyze the verdicts. - The aim of this study was to create an understanding how verdicts in the Swedish appeal court describes the best interest of the child, child’s will and the risks around children when theres is a parent with addiction problems. This study was based on a qualitative content analysis of twelve verdict from the appeal court. The verdicts did not have any geographical boundaries and the verdicts were published from year 2010 to 2019. Social constructionism and Michel Foucault power perspective were used to analyze the verdicts. Results from the study showed that there is no definition of the best interest of the child in the Swedish appeal court. The results showed that the best interest of the child is described as individual baseda and the care of ability. Results from the verdicts also showed that the best interest of the child is when there is no conflicts between the parents and there needs to be cooperation and communication between the parents. The child also needs stability and continuity but the verdicts also showed that the child might need to have contact with both of the parents even when there is an addiction problem in one of the parents. The verdict sometimes described the child's will as affected by others and also invisible because of their age. Small children are decried as not being able to express their will. The risk of the child around a parent with addiction problems can be a dangerous environment for the child but there is no expression by the children how they feel around the environment. Conclusion of the study showed that theres is more of a parent perspective than a child perspective in Swedish appeal courts. (Less)
