Hårdhandskar eller silkesvantar? – en rättsanalytisk granskning av särbehandlingen av unga lagöverträdare

Abstract (Swedish)
I det svenska straffrättsliga systemet finns en lång tradition av att särbehandla unga lagöverträdare. Den vedertagna ideologiska uppfattning som ligger till grund för särregleringen framhåller att unga har en outvecklad ansvarsförmåga, att de besitter en ökad sanktionskänslighet samt att samhället bör visa tolerans för den unges mognadsprocess. För de yngsta lagöverträdarna måste även hänsyn tas till principen om barnets bästa. Samtidigt ställs krav på proportionalitet, förutsebarhet, transparens, ekvivalens och rättssäkerhet enligt de allmänna straffrättsliga principerna.
Denna identifierade intressemotsättning kallas enligt mina teoretiska utgångspunkter för welfare/justice-konflikten.

Initialt i uppsatsen undersöks de skillnader som finns mellan unga och vuxna lagöverträdare som ligger till grund för själva intressekonflikten. Här lyfts neurologisk och psykologisk forskning in såväl som en genomgång av de vägledande straffrättsliga principerna. Överväganden bakom framväxten av gällande reglering såväl som föreslagen reglering undersöks och analyseras utifrån de motstående intressena för welfare och justice.

I de flesta fall kan överväganden och reglering förklaras med att intresset för welfare eller justice kombinerats eller att det ena intresset fått stå tillbaka för det andra. Vad gäller det föreslagna slopandet av den så kallade ungdomsreduktionen drar jag dock slutsatsen att förslaget inte till fullo korresponderar med varken intresset för welfare eller intresset för justice. Här öppnas upp för att ett tredje intresse tar plats i konflikten och det föreslås ett alternativt sätt att förstå lagstiftarens överväganden. (Less)

In the Swedish criminal justice system, there is a long tradition of treating young offenders differently than adults. The accepted ideological view that underlies the special regulation emphasizes that young people have an undeveloped capacity for responsibility, that they have a greater sensitivity to punishment and that society should show tolerance for the young person's maturation process. For the youngest offenders, the principle of the best interest of the child must also be considered. At the same time, proportionality, predictability, transparency, equivalence and legal certainty are required in accordance with the general principles of criminal law. The accepted ideological view that underlies the special regulation emphasizes that young people have an undeveloped capacity for responsibility, that they have a greater sensitivity to punishment and that society should show tolerance for the young person's maturation process. For the youngest offenders, the principle of the best interest of the child must also be considered. At the same time, proportionality, predictability, transparency, equivalence and legal certainty are required in accordance with the general principles of criminal law. According to my theoretical starting points, this identified conflict of interest is called the welfare/justice clash.

Initially, this thesis examines the differences that exist between young and adult offenders that form the basis for the conflict of interest itself. Here, developmental neurological and psychological research is highlighted as well as a review of the guiding principles of Swedish criminal law. The considerations behind the emergence of current regulation are examined, as well as the proposed regulation being examined and analyzed on the basis of the opposing interests for welfare and justice.

In most cases, considerations and regulation can be explained by the fact that the interest in welfare or justice has been combined or that one interest has been left aside for the other. With regard to the proposed abolition of the so-called youth reduction, however, I conclude that the proposal does not correspond to the interest in welfare or interest in justice. Here I open for a third interest to take place in the conflict and thus propose an alternative way of understanding legal developments in the area. (Less)
