- Abstract
- The Swedish social services are the authorities that have the right to take a minor into custody
without the consent of either the minor or its parents. In order to do so, thorough investigations have
to show that there are deficiencies in the child’s home environment or in his or her behavior.
Nor the less, there also must be a significant risk that the minor’s health and development will be
harmed. This is regulated in the Swedish law – LVU (Lag om vård av unga (1990:52))
The use of the term “significant risk” can be problematic, as the courts have to make individual

This study aims to analyze how Swedish courts apply and motivate the use of the prop “significant
risk” within cases where LVU is applicable.
The study is implemented as a qualitative, empirical study, with a selection of court decisions from
three Swedish cities – Göteborg, Växjö and Umeå.
The results show quite various application of LVU and the prop “significant risk”. Some courts have
very well motivated decisions with reference to either the law itself, or to higher court decisions.
These references not only explain the reasons behind the decision, but also contributes to a
transparent usage of the law, aiming for consistency.
On the other hand, the results also show a great lack of motivation in some cases. These decisions
mainly refer to the other props and automatically implement the “significant risk” without further
explanation.
Therefore my conclusion of the study is that the Swedish courts should aim for more detailed
motivations in their court decisions, to increase legal certainty and a higher level of predictability. (Less) - Abstract (Swedish)

Med utgångspunkt i detta undersöker denna studie huruvida tre förvaltningsrätter i södra, mellersta
och norra Sverige tillämpar rekvisitet påtaglig risk på ett rättssäkert sätt.
Syftet med studien är att undersöka förvaltningsrätters tillämpning av rekvisitet ”påtaglig risk” enligt
2-3 §§ LVU ur ett rättssäkerhetsperspektiv.
En klassisk rättsdogmatisk metod tillämpas i den första, beskrivande delen som redogör för
lagstiftningen samt rättssäkerhetsteorier. Beträffande själva undersökningen, görs en kvalitativ
empirisk studie av 30 st domar från 2020 av förvaltningsrätterna i Växjö, Göteborg och Umeå.
Studieresultatet analyseras ur synvinklar som är relevanta utifrån de teorier som beskriver
rättssäkerhetsaspekten. Jag har tittat på hur förvaltningsrätterna motiverar sina bedömningar av
rekvisitet påtaglig risk, huruvida domsluten gör hänvisningar till övriga rättskällor, samt huruvida
besluten kan ses som förutsebara.
Resultatet presenterar en något blandad bild. Samtliga förvaltningsrätter redogör för vad lagens
paragrafer säger, vissa mer kortfattat, andra mer utförligt. En del förvaltningsrätter gör däremot ett
väldigt kortfattat konstaterande av den påtagliga risken, medan andra diskuterar och analyserar
rekvisitet mer djupgående.
Ett fåtal förvaltningsrätter redogör för vad aktuella förarbeten säger om rekvisitets tillämpning,
medan de flesta inte gör någon sådan hänvisning alls.
Sammantaget konstateras att en djupare motivering av förvaltningsrättens beslut samt hänvisning till
övriga instanser och förarbetens motiveringar skulle i högre grad bidra till rättssäkerheten. (Less)
