När är en bild barnpornografisk?
Frågan kan utredas rättsdogmatiskt, men också empiriskt genom att
domstolarnas prövningar av misstänkt barnpornografiska bilder undersöks. Det är inte självklart att de olika utredningsmetoderna ger samstämmiga svar; domare dömer inte nödvändigtvis på ett sätt som överensstämmer med gällande rätt. I den här undersökningen jämfördes innebörden av barnpornografi enligt gällande rätt med domstolarnas prövningar av misstänkt barnpornografiskt material.

När är en bild barnpornografisk?
Frågan kan utredas rättsdogmatiskt, men också empiriskt genom att
domstolarnas prövningar av misstänkt barnpornografiska bilder undersöks. Det är inte självklart att de olika utredningsmetoderna ger samstämmiga svar; domare dömer inte nödvändigtvis på ett sätt som överensstämmer med gällande rätt. I den här undersökningen jämfördes innebörden av barnpornografi enligt gällande rätt med domstolarnas prövningar av misstänkt barnpornografiskt material.
En rättsdogmatisk undersökning genomfördes för att utreda innebörden av begreppet barnpornografi, och för att identifiera omständigheter som borde ha betydelse i domstolarnas prövningar. Av undersökningen framkom att rekvisiten barn och pornografisk bild inte alltid är okomplicerade. Bedömning av rekvisitet barn kräver ofta en bedömning av den skildrades pubertetsutveckling, och rekvisitet pornografisk bild saknar en tydlig definition.
26 stycken tingsrättsdomar analyserades i en empirisk undersökning. Fokus var att identifiera omständigheter och bevisning som har avgörande betydelse i prövningarna.
Resultatet av den empiriska undersökningen visar att tingsrätterna, vid bedömningen, ofta hänvisar till den tilltalades erkännande/medgivande, samt till den bedömning som gjorts av Polismyndighetens fingranskare. Hänvisningar till vad som framgått av själva bilderna är mindre vanliga.
Rekvisiten och andra omständigheter som är relevanta enligt gällande rätt diskuteras sällan i de fall då bilderna bedöms utgöra barnpornografi. I de fall då bilderna inte bedöms utgöra barnpornografi är tingsrätternas motiveringar mer utförliga. (Less)

The issue can be investigated with a legal dogmatic method, but also with
an empirically method and by examining the courts' trials regarding suspected child pornographic material. It is not obvious that the different methods of investigation provide consistent answers; judges do not necessarily decide in a manner consistent with applicable law. When does an image constitute child pornography?
The issue can be investigated with a legal dogmatic method, but also with
an empirically method and by examining the courts' trials regarding suspected child pornographic material. It is not obvious that the different methods of investigation provide consistent answers; judges do not necessarily decide in a manner consistent with applicable law. In this investigation, the meaning of child pornography under applicable law was compared with the courts' assessments of suspected child pornographic material.
A legal dogmatic study was conducted to investigate the meaning of the concept of child pornography, and to identify circumstances that should be relevant in the courts’ assessments. The study showed that the necessary prerequisites child and pornographic image are not always uncomplicated. To determine if a person is a child, pubertal development often must be assessed, and the meaning of pornographic image lacks a clear definition.
26 judgements from the lower courts were analysed in an empirical study. The focus was on identifying circumstances and evidence that are of decisive importance in these trials.
The results of the empirical study show that the lower courts, in the assessment, often refer to the defendant's confessions/admission, as well as to the assessment made by the Police Authority's fingranskare. References to what appeared in the pictures themselves are less common.
The necessary prerequisites and other circumstances that are relevant under applicable law are rarely discussed in cases where the images are considered to constitute child pornography. In cases where the images are not considered to constitute child pornography, the courts' grounds for decision are more detailed. (Less)
