Abstract
The purpose of this thesis has been to investigate to what extent young people who are subjected to violence by a partner whom they neither are married to nor cohabiting with, are considered to have a close relationship to the perpetrator according to the offence of gross violation of integrity, and to analyze how the vulnerability of young people in violent youth relationships is being assessed in the application of this provision. The purpose of this thesis has been to investigate to what extent young people who are subjected to violence by a partner whom they neither are married to nor cohabiting with, are considered to have a close relationship to the perpetrator according to the offence of gross violation of integrity, and to analyze how the vulnerability of young people in violent youth relationships is being assessed in the application of this provision. Based on preparatory work and a precedent from the Swedish Supreme Court, it can first of all be established that the determining factor for a young person to be regarded as having a close relationship to the perpetrator is that he or she, due to bonds to the perpetrator, has been in a particularly vulnerable situation. The case law study which has been conducted within this research indicates, however, a lack of consistency in the interpretation of the requirement to have a close relationship to the perpetrator in cases regarding youth intimate partner violence. In some cases young people are considered to be in a close relationship solely due to the fact that they have an emotional bond with each other. In several cases, however, due to the lack of a practical bond between the youth, for instance if the abused is a minor and therefore subject to the parental responsibility of his or her parents, the victim is deemed not to be in a close relationship to the perpetrator, despite the fact that the he or she has been subjected to such repetitive and systematic violence against which the provision aims to protect. Furthermore, in some cases young people are considered not to fulfil the necessary prerequisite due to the fact that the safety and stability provided by adults in the vicinity of the victim is considered to result in him or her not being in a particularly vulnerable situation. Lastly, it can be stressed that the assessment of whether the victim has a close relationship to the perpetrator should, to a greater extent than is being done by the courts today, take into account the youth-specific context in which the violence occurs. Such circumstances that can lead to the young person, due to his or her age, being more vulnerable and able to be subjected to repetitive partner violence should be considered of importance when assessing whether the victim has been in such a particularly vulnerable situation that motivates an application of the provision of gross violation of integrity. Syftet med uppsatsen har varit att undersöka i vilken utsträckning unga personer som utsätts för våld av en partner med vilken de varken är gifta eller sambo omfattas av närståenderekvisitet i brottet grov fridskränkning och att analysera hur ungas utsatthet vid våld i ungas partnerrelationer bedöms vid tillämpningen av detta brott. Med utgångspunkt i förarbeten och prejudikat från Högsta domstolen kan det inledningsvis konstateras att det avgörande för att en ung person ska omfattas av närståendebegreppet är att denne, på grund av bindningar till gärningspersonen, befunnit sig i en särskilt utsatt situation. Det förekommer att ungdomar bedöms som närstående uteslutande på den grund att de har haft en känslomässig bindning till varandra. I flera fall anses emellertid avsaknaden av en praktisk bindning mellan parterna, exempelvis på grund av att den utsatta fortfarande befunnit sig under vårdnadshavarens ansvar eller bott hemma hos föräldrarna, medföra att ungdomen inte omfattas av närståendebegreppet, trots att det varit fråga om sådant upprepat och systematiskt våld som bestämmelsen syftar till att skydda emot. Vidare förekommer det att ungdomar inte anses närstående eftersom den trygghet och stabilitet som vuxna individer i den utsattes närhet står för bedöms medföra att hen inte befunnit sig en särskilt utsatt situation. Slutligen kan det framhållas att bedömningen av om målsäganden omfattas av närståendebegreppet, i högre utsträckning än vad som idag sker i rättstillämpningen, bör ta hänsyn till den ungdomsspecifika kontext som våldet sker i. Omständigheter som kan innebära att den unga personen, på grund av sin ålder, är mer sårbar och kan utsättas för upprepat våld i sin partnerrelation bör tillmätas betydelse vid bedömningen av om målsäganden befunnit sig i en sådan särskilt utsatt situation som motiverar en tillämpning av fridskränkningsbrottet.
