Abstract
Certain decisions of the government ministry known as IVO or inspektionen för vård och omsorg (loosely translated: The inspection for health and care) leave the individuals affected without legal recourse. This is justified by the decisions classification as mere criticisms without serious effect on the people being criticised, however many of the government bodies responsible for the hiring of health and care professionals use registries of these criticisms in their hiring process.

Certain decisions of the government ministry known as IVO or inspektionen för vård och omsorg (loosely translated: The inspection for health and care) leave the individuals affected without legal recourse. This is justified by the decisions classification as mere criticisms without serious effect on the people being criticised, however many of the government bodies responsible for the hiring of health and care professionals use registries of these criticisms in their hiring process.

This paper investigates whether the use of these criticisms ought to be considered too potent to leave the individuals affected by them without any legal recourse. Whether this might be an unintended effect on the part of the lawmakers and whether there is any current contradictive recourse within already existing law.

this paper finds that there is indeed fairly widespread use of the criticisms in the hiring process although it finds that the import attested to them by the agencies responsible for hiring varies somewhat and is left unclear by many.

This Paper finds little recourse for affected individuals within already existing law in spite of a reasonable interest among affected individuals to protect their good professional standing (Less)

Vissa av myndigheten IVO:s utlåtanden är icke överklagbara detta trots att de av vissa viktiga arbetsgivare används som grund vid nyrekrytering av vårdpersonal. Uppsatsen utreder hur tungt olika arbetsgivare värderar IVO:s information och om detta kan orsaka kontradiktioner inom lagen genom att en icke överklagbar myndighetsåtgärd blir ett större ingrepp grepp i individens liv än vad lagstiftaren kanske avsett.

Utredningen visar att lagstiftaren förutsåg vissa problem men beslöt att lämna det tills vidare utredning hade skett. Att regionerna som ansvarar för rekrytering av vårdpersonal till viss del nyttjar IVO:s register som anställningsunderlag och att vissa lägger stor tyngd därvid medan andras användning förblir oklar.
