Integrationskrav för permanent uppehållstillstånd - en jämförelse mellan regelverken i de skandinaviska länderna med fokus på skyddsbehövande

I samtliga skandinaviska länder ställs det krav på den enskilde för att ett permanent uppehållstillstånd ska kunna beviljas. Kraven handlar bland annat om försörjningsförmåga, språkkunskaper och samhällskunskaper. Gemensamt för kraven är att de syftar till att öka integrationen av de utlänningar som befinner sig i landet. Genom att villkora det permanenta uppehållstillståndet med olika integrationskrav avser lagstiftaren att skapa motivation och incitament för utlänningen att arbeta för sin egen integration.

I samtliga skandinaviska länder ställs det krav på den enskilde för att ett permanent uppehållstillstånd ska kunna beviljas. Kraven handlar bland annat om försörjningsförmåga, språkkunskaper och samhällskunskaper. Gemensamt för kraven är att de syftar till att öka integrationen av de utlänningar som befinner sig i landet. Genom att villkora det permanenta uppehållstillståndet med olika integrationskrav avser lagstiftaren att skapa motivation och incitament för utlänningen att arbeta för sin egen integration.

Att villkora det permanenta uppehållstillståndet är nytt i den svenska migrationsrätten. Liknande reglering finns dock i den danska och den norska migrationsätten. För att undersöka den svenska lagstiftningen har därför en komparativ studie gjorts mellan de skandinaviska länderna, med fokus på skyddsbehövande. Av jämförelsen framgår att den svenska rätten rört sig mot den ordning som råder i dansk rätt och norsk rätt. Slutsatsen är dock att det fortfarande är stor skillnad mellan ländernas regleringar.

I uppsatsen diskuteras även några effekter som integrationskraven kan leda till utifrån rättsfilosofisk, statsvetenskaplig och sociologisk litteratur. Av litteraturen framgår att det finns flera intressen som måste vägas in när utlänningens rättsliga tillhörighet villkoras. Kraven bör, bland annat, inte vara för svåra att uppnå med resultatet att utlänningen har ett tidsbegränsat uppehållstillstånd oproportionerligt länge. Kraven bär även en risk att användas till exkludering av oönskade utlänningar i stället för inkludering av samtliga utlänningar. Den slutsats som kan dras av diskussionen är att det måste råda en balans mellan de motsatta intressena som aktualiseras när det permanenta uppehållstillståndet villkoras av integrationskrav. (Less)

The applicant for a permanent residence permit must, in all Scandinavian countries, fulfil certain requirements. The requirements are, among other things, that the applicant can support itself financially or that it has knowledge of the national language and society. The commonalities of these requirements are that they aim to increase the integration of the foreigners who resides in the country. By conditioning the permanent residence permit with integration requirements, the legislator aim to create incentive for the foreigner to integrate.

The applicant for a permanent residence permit must, in all Scandinavian countries, fulfil certain requirements. The requirements are, among other things, that the applicant can support itself financially or that it has knowledge of the national language and society. The commonalities of these requirements are that they aim to increase the integration of the foreigners who resides in the country. By conditioning the permanent residence permit with integration requirements, the legislator aim to create incentive for the foreigner to integrate.

The comparison shows that a cohesion has taken place. The Swedish migration law has moved towards the legislation in Danish and Norwegian law. Yet, one conclusion from the comparative study is that there still are significant differences between the three countries’ legislation.

The essay also discusses some effects of the integration requirements. The discussion emanates from literature within the fields of philosophy of law, political science, and sociology. The literature shows that there are many interests that need to be addressed when an individual’s legal belonging to a country is conditioned by integration requirements. The requirements should preferably, among other things, not be too hard to fulfil. Such requirements would result in an unproportionally long period of temporary residence permits for the foreigner. The requirements do also carry a risk of being used for exclusion of unwanted foreigners, instead of inclusion of all foreigners. The conclusion that can be drawn from the discussion is that there is a need for balance between the opposing interests that occur when the permanent residence permit is conditioned by integration requirements.
