EU-kommissionens direktivförslag om tillräckliga minimilöner - En analys av förslagets rättsliga grund och möjliga effekt på den svenska arbetsmarknadsmodellen

Abstract (Swedish)

EU-kommissionen har, som ett led i arbetet mot ett mer socialt Europa, presenterat ett förslag till direktiv avseende tillräckliga minimilöner tillåtandes en skälig levnadsstandard. Direktivförslaget hänvisar till EU:s befogenheter att införa åtgärder på området för arbetsvillkor. På svensk arbetsmarknad har kritiken gentemot direktivförslaget varit stor och de föreslagna åtgärderna beskriv som ett hot mot den svenska arbetsmarknadsmodellen.

Uppsatsen syftar dels till att undersöka direktivförslagets förhållande till begränsningen av EU:s befogenheter avseende lön. Dels syftar uppsatsen till en analys av de möjliga sätt som direktivförslaget skulle kunna komma att påverka den svenska arbetsmarknadsmodellen och lönebildningen.

Utifrån den gällande rätten konstateras i analysen att direktivförslagets presenterade åtgärder och dess förenlighet med EU:s befogenheter på området inte med säkerhet går att utröna utifrån gällande rättsläge. Av EU-domstolens begränsade praxis på området framgår att den avgörande frågan är om de presenterade åtgärderna är att likställa med en direkt inblandning av medlemsländernas löner. Vidare konstateras i analysen att de presenterade åtgärderna i direktivförslaget syftar till att etablera de redan existerande löneskyddssystemen i respektive medlemsland. Av de föreslagna åtgärderna framgår inget som tyder på etablerande av en individuell rätt till minimilön och direktivförslaget synes därmed inte utgöra det hot mot den svenska modellen som kritikerna befarar.

Abstract

The European Commission has, as part of the work towards a more social Europe, presented a proposal for a directive regarding sufficient minimum wages allowing a fair standard of living. The proposed directive refers to the EU's powers to introduce measures in the field of working conditions. In the Swedish labor market criticism of the proposed directive has been great and the proposed measures are described as a threat to the Swedish labor market model.

The thesis aims partly to examine the relationship of the proposed directive to the limitation of the EU's powers regarding pay. On the other hand, the thesis aims at an analysis of the possible ways in which the proposed directive could affect the Swedish labor market model and wage formation.

Based on the applicable law the analysis states that the measures presented in the proposed directive and its compatibility with the EU's powers in this area cannot be ascertained with certainty on the basis of the current legal situation. The European Court of Justice's limited practice in this area shows that the crucial question is whether the measures presented are to be equated with a direct interference with the salaries of the member states. Furthermore, the analysis states that the measures presented in the proposed directive aim to establish the already existing wage protection systems in each member state. The proposed measures do not indicate establishment of an individual right to a minimum wage, and the proposed directive does therefore not appear to pose the threat to the Swedish model that critics fear.
