- Uppsatsens syfte är att undersöka utvecklingen av efterlevande makes arvsrätt i Finland och Sverige under 1900-talet, med fokus på argumentationen bakom den. De är två länder med nära historiskt, samhälleligt och kulturellt samband, vilket gör rättshistorien och jämförelsen intressant. Utvecklingen startade från att makarna inte hade någon arvsrätt alls i länderna och gick hand i hand ända fram till 1980-talet, då Sverige införde arvsrätt med fri förfoganderätt för efterlevande maken, medan Finland införde rätt för efterlevande att sitta i oskiftat bo. Utvecklingen startade från att makarna inte hade någon arvsrätt alls i länderna och gick hand i hand ända fram till 1980-talet, då Sverige införde arvsrätt med fri förfoganderätt för efterlevande maken, medan Finland införde rätt för efterlevande att sitta i oskiftat bo. Under seklet ökade efterlevande makes behov av ekonomiskt stöd medan bröstarvingarnas behov minskade, i takt med att bådas medelålder steg. - The purpose of this paper is to study how the surviving spouse’s inheritance rights in case of death of the other spouse have developed during the twentieth century in Finland and Sweden. The focus will be on the arguments behind the legislations and how they developed during the reforms over the years, and how they differ, or don’t, between the two countries. Due to the countries’ shared history and cultural and societal values they make for an interesting historical comparison. - The purpose of this paper is to study how the surviving spouse’s inheritance rights in case of death of the other spouse have developed during the twentieth century in Finland and Sweden. The focus will be on the arguments behind the legislations and how they developed during the reforms over the years, and how they differ, or don’t, between the two countries. Due to the countries’ shared history and cultural and societal values they make for an interesting historical comparison. The development started from the spouses having no inheritance rights at all in the in the early nineteen hundreds and went hand in hand until the 1980s, when Sweden introduced inheritance rights for the surviving spouse before the direct heirs, while Finland introduced the right for the spouse to live in the joint residence. The arguments and reasons behind the development were nevertheless similar in both countries. During the century, the surviving spouse's need for financial support increased, while the need of the direct heirs diminished, as their average age increased. The family and the state took on a greater role than the relatives in the maintenance and support of the surviving spouse. (Less)
