- I Sverige gäller som huvudregel att all vård ska vara frivillig och samhället är gentemot det allmänna skyddade från påtvingade kroppsliga ingrepp. Undan-tag finns dock som gör det möjligt för allvarligt psykiskt sjuka att bli tvingade till vård. Jag har som väktare upplevt hur en tillämpning av Lagen om psykia-trisk tvångsvård (1991:1128) sett ut på nära hand. Jag har genom denna erfa-renhet fått upp ögonen för områden som inte visat sig speciellt klara. Genom uppsatsen för man följa den tråd som jag upplevde denna dag på akutmottag-ningen. Uppsatsen kommer genom relevanta principer och diskussioner av rättsläget först föra in läsaren i hur dessa bör utläsas för att sedan förklara hur avvägning mellan lagrummen och principerna ska göras. ... LPT förespråkas för att kunna ta till fasta de personer som inte kan uppskatta sitt eget vårdbehov eller som inte ser den fara denne kan göra för sin omgiv-ning. Åtgärderna som används för att upprätthålla detta kan i många lägen vara väldigt långtgående förbi den individuella autonomin. Det kan även fin-nas ett syfte att denna tvångsbehandling utförs av personer som vet var denna gräns ska dras. Där utreder uppsatsen genom en rättsdogmatisk metod i två frågeställningar, om hur långt dessa åtgärder får lov att sträcka sig och om dessa befogenhet tillfaller hälso- och sjukvårdspersonal, andra yrkesgrupper eller envar. However, exceptions exist that allow for the compulsory treatment of individuals with severe mental illness. As a security guard, I have experienced firsthand the application of the Act on Compulsory Psychiatric Care (Lagen om psykiatrisk tvångsvård (1991:1128)). Through this experience, I have become aware of areas that have not been particularly clear. This essay aims to trace the events of that day in the emergency department, employing relevant principles and discussions of legal considerations to guide the reader. The essay will first explore how these principles should be interpreted and then explain how a balance between legal provisions and principles should be struck.
The Act on Compulsory Psychiatric Care (LPT) advocates for the ability to intervene in cases where individuals are unable to appreciate their own need for care or the harm they may pose to others. The measures used to uphold this can, in many instances, significantly impinge on individual autonomy. It may also serve the purpose that such coercive treatment is carried out by individuals who understand where this boundary should be drawn. Using a legal dogmatic approach, this essay will investigate two questions: how far these measures are allowed to extend and whether these powers are vested in healthcare professionals, other professional groups or to everyone.
