- Although the police are meant to serve and protect its citizens, recent reports show that an alarming number of police officers in Sweden have been subjected to accusations of committing unauthorized registry searches. This study thus aimed to generate knowledge about several police attitudes toward unauthorized data access within the Swedish Police Authority. The research questions, therefore, focused on which searches the police officers recognized to be permitted and non-permitted respectively, as well as how the police officer’s knowledge of the legislation influenced these perceptions. The analysis in the study applied the theoretical framework of Hydén’s norm model to understand the results more deeply. Moreover, this study contributes to the field of Sociology of Law by examining the knowledge and opinion about law of several police officers.
This thesis argues that the searches perceived to be allowed are the ones that are necessary in their line of work, which is in accordance with the legalisation. However, the study found ambiguous perceptions of how to apply the rules in practice. Moreover, the results suggest that the police officer’s knowledge and perception of the legislation in the area are affected by their own interpretations. More specifically, this concerns varying interpretations of the legal requirement that a search ought to be necessary for a certain work task. This perception may be the result of a norm conflict between police duties, societal obligations, and legal rules. (Less)
