- This paper examines the arguments for and against new legislation on insider trading in the US Congress and explores the correlation between insider trading and corruption. The purpose of the paper is to determine whether refraining from implementing additional legislation can be justified. Through argument analysis and the theoretical framework of an ideal type, the paper identifies a conflict of values between those prioritizing public trust in Congress and those emphasizing the individual rights of Congressmen. The analysis suggests that insider trading by Congressmen constitutes corruption and that the arguments against new legislation also exhibit corrupt traits. The paper emphasizes that the legitimacy of Congress derives from representing the people and highlights the predominantly negative consequences of corruption. It concludes that new legislation on insider trading is justified. However, it acknowledges the cultural importance of individualism in the US. This dual perspective underscores the complexity of balancing public trust and individual rights within legislative reforms. Ultimately, the paper argues that enhancing regulations on insider trading is necessary to maintain the integrity and legitimacy of the US Congress. (Less)
