Denna uppsats har två syften. Det första syftet är att utreda hur filmcensur för vuxna i Sverige har utvecklats, motiverats och kritiserats mellan 1911-2011 med hjälp av den rättshistoriska metoden. Uppsatsens andra syfte är att utreda om lagstiftarens sätt att motivera filmcensuren för vuxna någonsin var hållbar utifrån ett kritiskt perspektiv.

Avhandlingen använder främst förarbeten till lagar om filmcensur och litteratur för att visa hur filmcensuren för vuxna har utvecklats, motiverats och kritiserats mellan 1911-2011. Denna uppsats har två syften. Det första syftet är att utreda hur filmcensur för vuxna i Sverige har utvecklats, motiverats och kritiserats mellan 1911-2011 med hjälp av den rättshistoriska metoden. Uppsatsens andra syfte är att utreda om lagstiftarens sätt att motivera filmcensuren för vuxna någonsin var hållbar utifrån ett kritiskt perspektiv.

Avhandlingen använder främst förarbeten till lagar om filmcensur och litteratur för att visa hur filmcensuren för vuxna har utvecklats, motiverats och kritiserats mellan 1911-2011. När filmvisningar fick sitt genomslag i början på 1900-talet så blev lagstiftaren orolig för att omoraliska filmer skulle påverka befolkningen negativt. Följaktligen etablerades biografförordningen 1911, vilket innebar att Statens biografbyrå kunde klippa eller totalförbjuda biograffilmer. Under 1900-talet andra halva började allt fler kritisera filmcensuren för vuxna. Exempelvis kritiserades filmcensuren för vuxna eftersom det saknades otvetydigt bevis för att filmer kunde skada vanliga vuxna medborgare. Utöver detta var yttrandefrihetens förbättrade rättsliga ställning och den teknologiska utvecklingen bidragande till den ökade kritiken mot filmcensuren. I samband med att filmcensuren blev svårare att motivera så valde man att ta bort flera censurgrunder, dock dröjde det först till 2011 innan lagstiftaren helt avskaffade filmcensuren för vuxna. Både det politiska klimatet och lagstiftarens övertygelse om att det fanns ett behov av att skydda medborgaren från filmens skadeverkningar var bidragande faktorer till att filmcensuren för vuxna existerade i 100 år.

Uppsatsens analys visar att lagstiftarens sätt att motivera filmcensuren för vuxna, utifrån ett kritiskt perspektiv, aldrig var hållbart. Enligt analysen har det alltid saknats särskilt viktiga skäl för att använda filmcensur för vuxna. Utöver detta konkluderar analysen att filmcensuren alltid har varit ineffektiv och resulterat i en oproportionerlig inskränkning av flera viktiga intressen. (Less)

The first purpose is to investigate how movie censorship for adults in Sweden has been developed, motivated and criticized between 1911-2011 using the legal historical method. The essay's second purpose is to investigate whether the legislator's way of justifying film censorship for adults was ever sustainable from a critical perspective.

The thesis mainly uses preparatory work for laws focused on film censorship and literature to show how film censorship for adults has been developed, justified and criticized between 1911-2011. This essay has two aims. The first purpose is to investigate how movie censorship for adults in Sweden has been developed, motivated and criticized between 1911-2011 using the legal historical method. The essay's second purpose is to investigate whether the legislator's way of justifying film censorship for adults was ever sustainable from a critical perspective.

The thesis mainly uses preparatory work for laws focused on film censorship and literature to show how film censorship for adults has been developed, justified and criticized between 1911-2011. When movie screenings gained traction at the beginning of the 20th century, legislators became concerned that immoral films would negatively affect the population. Consequently, the Cinema Ordinance was established in 1911, which meant that the national Censorship Board could cut or completely ban movies. Since the 1950s, more and more people began to criticize movie censorship for adults. For example, movie censorship for adults was criticized because there was a lack of unequivocal evidence that films could harm ordinary adult citizens. In addition to this, the improved legal status of freedom of expression and technological development also contributed to the increased criticism of movie censorship. In connection with film censorship becoming more difficult to justify, it was decided to remove several grounds for censorship, however it was only until 2011 before the legislature completely abolished movie censorship for adults. Both the political climate and the legislature's belief that there was a need to protect citizens from the harmful effects of movies were contributing factors to the existence of movie censorship for adults for 100 years.

The essay's analysis shows that the legislator's way of justifying movie censorship for adults, based on a critical perspective, was never sustainable. According to the analysis, there has never been a strong reason for using movie censorship for adults. In addition to this, the analysis concludes that film censorship has always been ineffective and resulted in a disproportionate restriction of several important interests. (Less)
