- Abstract
- In the early 1970s, the Swedish legislative body decriminalized the act of insulting a state official. However, in 2024 an investigation on the request of the government proposed to reintroduce the same offense. This essay analyzes the proposal in light of historical changes in the law and the current legislation in Sweden and Finland.
The investigative chapter first addresses the former prohibition of insulting a state official and its decriminalization. Then the current regulation of the general prohibition against insults, with a focus on public officials and its relation to freedom of expression, are examined. The proposal to reintroduce the offence of insulting a state official is then introduced, followed by an overview of Finland’s... The investigative chapter first addresses the former prohibition of insulting a state official and its decriminalization. Then the current regulation of the general prohibition against insults, with a focus on public officials and its relation to freedom of expression, are examined. The proposal to reintroduce the offence of insulting a state official is then introduced, followed by an overview of Finland’s current regulation regarding insults against state officials.
The comparative analysis reveals that Finland’s legislation offers more robust protections for both state officials and freedom of speech compared to the current Swedish regulation. While the Swedish proposal seeks to enhance the protection of state officials it risks negatively impacting freedom of speech.
Future regulation should consider the distinction of legal protection between individuals and state officials as well as the balance between protection and responsibility for state officials. The proposed regulation implies a restriction on freedom of speech; potentially affecting the free formation of opinions. Introducing a legally regulated right to criticize would clarify what is permitted and help the legislative body draw a clearer boundary between the protection from defamation and freedom of expression. In conclusion, while the Swedish proposal aims to strengthen the protection of state officials, it must be balanced against the necessity to uphold freedom of speech. A revised proposal incorporating elements from the Finnish legislation could provide a more balanced framework; ensuring both the protection of public officials and the freedom of speech. Förslaget innebär en inskränkning i yttrandefriheten och kan på-verka den fria åsiktsbildningen negativt. En lagstadgad kritikrätt skulle tydliggöra vad som är tillåtet och hjälpa lagstiftaren att dra en tydligare gräns mellan skyddet för ärekränkning och yttrandefriheten. Medan det svenska förslaget syftar till att stärka skyddet för statliga tjänstemän, måste det vägas mot behovet av att upprätthålla yttrandefriheten. Ett reviderat förslag som inkorporerar element från den finska lagstiftningen skulle kunna ge en mer balanserad reglering, som säkerställer både skyddet av offentliga tjänstemän och yttrandefriheten.
