Abstract
This thesis explores the challenges associated with electronic legal deposit in Sweden, focusing on both its historical development and current legal framework. While the existing legislation for electronic legal deposit was introduced in 2012, it has not kept pace with technological advancements, resulting in significant gaps in the collection and preservation of digital publications. This thesis explores the challenges associated with electronic legal deposit in Sweden, focusing on both its historical development and current legal framework. While the existing legislation for electronic legal deposit was introduced in 2012, it has not kept pace with technological advancements, resulting in significant gaps in the collection and preservation of digital publications. The study aims to identify and analyze the core issues surrounding electronic legal deposit through a qualitative textual analysis of the 2021 government report Papper, Poddar och... (SOU 2021:32) and a selection of the consultation responses submitted by various stakeholders. The report proposes a unified legal deposit act that is neutral in terms of media, technology, and format, prioritizes content over form, and allows the National Library (KB) greater autonomy in decision-making. The analysis identifies central proposals in the report and highlights areas of conflict in the consultation responses – particularly regarding access to electronic material, copyright restrictions, and institutional authority. Findings suggest broad support for updating the legislation, but also reveal tensions between different interest groups, especially regarding accessibility and the division of responsibilities between key cultural institutions. The study contributes to a deeper understanding of the legal and institutional complexities involved in securing long-term digital preservation in Sweden. (Less)
