The purpose of this chapter is to discuss the legal issues relating to cruise ship passenger contracts, their nature and salient features, parties to the contract and their rights and obligations. Claims arising out of passenger carriage subject to applicable law and contracts containing standard terms and conditions are addressed. It is rare for passengers to examine the terms and conditions of the contract prior to the cruise. Whether the forum state is a party to any international convention related to passengers is a significant issue. The purpose of this chapter is to discuss the legal issues relating to cruise ship passenger contracts, their nature and salient features, parties to the contract and their rights and obligations. Claims arising out of passenger carriage subject to applicable law and contracts containing standard terms and conditions are addressed. It is rare for passengers to examine the terms and conditions of the contract prior to the cruise. Whether the forum state is a party to any international convention related to passengers is a significant issue. It must be stressed that not all states are parties to a particular convention that establishes international standards for the carrier's obligations and liabilities. In those states, national law applies. The impact of electronic transactions on drawing up of passenger contracts will be highlighted. The chapter includes a brief overview of the prevailing international regime relating to passengers carried by sea. The Athens Convention, 1974 and its Protocol of 2002 are now consolidated into the Athens Convention, 2002; their respective provisions are examined in this chapter. Also, a brief mention is made of the European Union (EU) regime relating to passengers and travelers.
