Abstract

This chapter explores Afghanistan's relationship with international law. Post-2001 statebuilding efforts in Afghanistan involved a strong commitment to reintegrating the Afghan state into the international legal system. However, a significant gap existed between formal commitments and on-the-ground realities. This chapter explores Afghanistan's relationship with international law. Post-2001 statebuilding efforts in Afghanistan involved a strong commitment to reintegrating the Afghan state into the international legal system. However, a significant gap existed between formal commitments and on-the-ground realities. This chapter examines Afghanistan's relationship with international law by focusing on four key aspects, including historical progression of engagement, relationship between international law and domestic law, enforcement mechanisms, and instances of transgressions. The analysis shows a complex and dynamic relationship, characterised by engagement and non-engagement, as well as violations. During the former Islamic Republic of Afghanistan, the country's relationship was marked by a mix of participation and transgression, positioning it both as an actor in and subject of international law. However, under the Taliban rule from August 2021, this relationship has deteriorated dramatically towards increased non-engagement and violations. Consequently, Afghanistan's role is evolving more into that of a violator and subject of international law, rather than a participant or contributor in shaping it.
