Abstract
Research has shown that the general attitudes towards emotions have shifted between different cultures as well as within one culture over different periods. During the Middle Ages, for example, control and reason were considered more desirable human qualities than emotions in Western societies. However, from the late 1700s emotions and empathy were described with increasingly positive terms. From now on love and emotional commitments were seen as human virtues. Research has shown that the general attitudes towards emotions have shifted between different cultures as well as within one culture over different periods. During the Middle Ages, for example, control and reason were considered more desirable human qualities than emotions in Western societies. However, from the late 1700s emotions and empathy were described with increasingly positive terms. From now on love and emotional commitments were seen as human virtues. This article examines what consequences this cultural change had upon the assessment of forbidden love relations in a legal context. By analysing three similar criminal cases from different time periods before, during and after the cultural change, it becomes apparent that both lawyers and delinquents were influenced by the cultural norms they were surrounded by. Implicitly, these notions of emotion also affected the actual verdict in some cases. (Less)

Känslor och känsloyttringar kan förefalla vara allmänmänskliga företeelser, men forskning visar att den generella inställningen till känslor har skiftat mellan olika kulturer såväl som inom en och samma kultur över olika tidsperioder. Under medeltiden värderades exempelvis kontroll och förnuft högre än känslosamhet i det västerländska samhället, men från och med sent 1700-tal kom känslor och kärlek att få allt positivare konnotationer. I den här artikeln undersöks vilka konsekvenser detta kulturella normskifte fick för bedömningen av förbjudna kärleksförbindelser i svenska domstolar. I den här artikeln undersöks vilka konsekvenser detta kulturella normskifte fick för bedömningen av förbjudna kärleksförbindelser i svenska domstolar. Genom att jämföra tre snarlika brottmål från olika tidsperioder före, under och efter normskiftet blir det uppenbart att såväl jurister som åtalade påverkades av och agerade efter de kulturella normer de var omgivna av. Indirekt fick detta även betydelse för vilken dom de åtalade fick. (Less)
