- Abstract
- This essay examines under what circumstances illness may constitute objective grounds for dismissal under Chapter 7, Section 1 of the Swedish Employment Protection Act (1982:80). The starting point in Swedish labour law is that illness as such does not justify dismissal. The purpose of the study is therefore to clarify the legal conditions under which illness may nonetheless result in a lawful termination of employment. The essay applies the legal dogmatic method and analyses statutory provisions, preparatory works and case law from the Swedish Labour Court. Particular attention is given to the requirements of permanent and substantial reduction of work capacity, the employer’s duty to provide rehabilitation, and the obligation to examine... (More)

The essay applies the legal dogmatic method and analyses statutory provisions, preparatory works and case law from the Swedish Labour Court. The implications of the 2022 reform, which replaced the concept of “just cause” with “objective grounds,” are also addressed. The analysis demonstrates that the threshold for dismissal due to illness is high. Illness may constitute objective grounds only when work capacity is permanently and substantially reduced, the assessment is supported by a medical and occupational prognosis, and the employer has fulfilled its rehabilitation and reassignment obligations. Ultimately, the legality of dismissal depends on a comprehensive assessment of the individual circumstances. (Less)
- Abstract (Swedish)
(More)

(Less)
