Ensam vårdnad - när den gemensamma vårdnaden fallerar

Sedan vårdnadsreformen år 1998 blev den gemensamma vårdnaden allt viktigare i svensk familjerätt. Domstolarna arbetade aktivt med att införliva gemensam vårdnad som norm och skapa en ny rättstradition som talade för denna vårdnadsform. I och med 2006 års vårdnadsreform togs presumtionen om gemensam vårdnad bort. Lagförslaget innebar inga förändringar angående domstolens behörighet att döma till gemensam vårdnad mot en förälders vilja. Domstolarna ska grunda sitt beslut på vilken vårdnadsform som är bäst för barnet beroende på omständigheterna som framkommer i det enskilda fallet. Domstolarna arbetade aktivt med att införliva gemensam vårdnad som norm och skapa en ny rättstradition som talade för denna vårdnadsform. I och med 2006 års vårdnadsreform togs presumtionen om gemensam vårdnad bort. Lagförslaget innebar inga förändringar angående domstolens behörighet att döma till gemensam vårdnad mot en förälders vilja. Domstolarna ska grunda sitt beslut på vilken vårdnadsform som är bäst för barnet beroende på omständigheterna som framkommer i det enskilda fallet. Vårdnadsreformen betonade betydelsen av rättens skyldighet att utreda de skäl som åberopas av vårdnadshavare när de motsätter sig gemensam vårdnad. Propositionen till 2006 års lagändring betonar betydelsen av att motsättningar mellan föräldrar ska tas på allvar och utredas. Vad som anses förenligt med barnets bästa är främst en nära och god kontakt med båda föräldrarna. Vid tvist om vårdnaden ankommer det på rätten att utreda varje enskild situation och besluta om vilken vårdnadsform som är lämpligast. Därefter har domstolen till uppgift att utreda om ett utövande av gemensam vårdnad är möjlig eller inte. Förarbetena till 2006 års vårdnadsreform samt analyserade rättsfall visar att de kriterier som kan vara av avgörande karaktär vid bedömningen är:
- Om den ena föräldern saboterat umgänget.
- Om det anses vara olämpligt att ”rycka upp barnet från dess invanda miljö”.
- Om föräldrarna har en så ”djup och svår konflikt” att de har samarbetssvårigheter i frågor som rör barnet.
- Om någon av, eller båda föräldrarna, anses vara olämpliga vårdnadshavare.

För att kunna fatta bästa möjliga beslut krävs att domstolen utreder varje situation noga för att utreda om tvisten är av så allvarlig karaktär att ett framtida samarbete omöjliggörs. Vid bedömningar i vårdnadstvister tas hänsyn till tidigare incidenter, men hänsyn tas även till eventuella framtida problem som kan uppstå. (Less)

Joint custody has been the main principle in Swedish Family Law since the custody reform of 1998. The Courts have ever since worked actively to implement joint custody as the main norm and to create a new legal tradition that advocates this form of custody. The presumption of joint custody was removed in the custody reform of 2006. The legislative proposal did however not result in any changes to the rights of the Courts to grant parents single custody against the will of the other parent. The Courts should base their decisions on what custody form that is in the best interest of the child and care should be given to specific circumstances in each court case. The presumption of joint custody was removed in the custody reform of 2006. The legislative proposal did however not result in any changes to the rights of the Courts to grant parents single custody against the will of the other parent. The custody reform emphasis the Courts responsibilities to investigate reasons when parents object joint custody. The proposition to 2006 custody reform also emphasis that conflicts between parents should be given due care and investigated. It has deemed to be in the best interest of the child to have a good and close contact with both parents. In legal disputes concerning custody it is the responsibility of the Court to investigate each specific case and decide what custody form that is most suitable. The courts are therefore obliged to investigate whether joint custody is possible or not. The legislative history of 2006 custody reform and analyzed court cases indicate that the criteria’s that are determinant for granting single custody are:
- If one parent is sabotaging relationship between the other parent and the child.
- If it is inappropriate to uproot the child from its current environment.
- If the parents have such a "deep and difficult conflict," that they have difficulties in cooperating on issues relating to the child.
- If either or both parents are unfit legal guardians.
In order for the Court to be able to make the best possible decision thorough investigations are required in each specific case to investigate whether the dispute is so deep that future cooperation will be impossible. Previous incidents and future potential incidents are also considered in child custody cases. (Less)
