Abstract (Swedish)
Syftet med denna uppsats är att analysera kommunernas lagefterlevnad och om den varierar beroende av vilken politisk majoritet som styr kommunen. Konkret kommer det att ske genom att vi analyserar i vilken utsträckning kommunerna implementerat lagen om kommunala bostadsaktiebolagen, manifesterat som större utdelningar och högre vinstmarginaler. Vi kommer att sätta detta i relation till om kommunerna anpassar sig efter den äldre lagstiftningen om det kommunala balanskravet.

Med hjälp av ett deduktivt kvantitativt angreppssätt genomförde vi en studie om trender i kommunala bostadsaktiebolag.

Uppsatsen behandlar huvudsakligen två teorier, Rational Choice och Institutionell teori. Dessa används för att analysera kommunalpolitikers agerande, vid deras respektive kommuns implementering av lagen om kommunala bostadsaktiebolag.

Empirin har huvudsakligen samlats in via databasen Retriever. Där all aktuell data fanns för samtliga kommunala bostadsaktiebolag över en tioårsperiod, mellan åren 2003 och 2012. Kompletterande data om politisk majoritet hämtades från Sveriges kommuner och landstings hemsida.

Kommunala bostadsaktiebolag har, över alla styrningskategorier, upplevt ökade vinstmarginaler sedan införandet av affärsmässig grund i lagen 2010. Samtidigt hade utdelningen 2011 ökat med hela 687 procent från år 2004, där majoriteten av ökningen skedde efter år 2009. Trots denna ökning, bekräftar vi att det finns kommuner som bryter mot det kommunala balanskravet, speciellt vänsterstyrda trots att de var de kommuner med högst total utdelning. (Less)
Abstract
The purpose of this thesis is to analyze the level of law-abidingness of the Swedish municipalities and if this level differs with political majority. We do this by looking at by which extent they have implemented the law concerning these housing companies. By examining trends on their level of profit margins and dividends. Lastly we put this in relation to whether the municipalities adapt to the somewhat older law concerning balance in the municipalities‟ finances.

We conducted our study by using a deductive quantitative analysis, to examine trends in housing companies owned by Swedish municipalities.

The studies empirical evidence has mainly been collected by using the database, Retriever. Where the data for all the 247 housing companies over a ten year period, between 2003 and 2012, was found. Data concerning political majority for the municipalities was found at SKLs official webpage.

The municipal housing companies, has since the introduction of commercial basis in the law of 2010, seen increased profit margins across all forms of political majority. At the same time, the level of dividends was 2011 up a whopping 687 percent from 2004. Despite this increase, we confirm that there are municipalities that violate the balance demand. Left wing municipalities more so than right wing, despite receiving higher levels of total dividends. (Less)
