Minimilönedirektivets dolda agenda - En rättsvetenskaplig analys av minimilönedirektivets kollektivavtalsfrämjande funktion

Abstract
The Minimum Wage Directive, despite its name, has an equally important agenda: to promote collective bargaining in the EU. Although the directive must be implemented into national legislation by November 2024, collective bargaining initiatives can already be observed among the member states. This thesis aims to provide a legal analysis of the directive's provisions and its function in promoting collective bargaining, with a focus on its potential impact on collective bargaining coverage in the member states. The analysis identifies indirect and direct measures that can increase collective bargaining coverage, which is relevant for 19 of the EU's 27 member states. The Minimum Wage Directive, despite its name, has an equally important agenda: to promote collective bargaining in the EU. Although the directive must be implemented into national legislation by November 2024, collective bargaining initiatives can already be observed among the member states. This thesis aims to provide a legal analysis of the directive's provisions and its function in promoting collective bargaining, with a focus on its potential impact on collective bargaining coverage in the member states. The analysis identifies indirect and direct measures that can increase collective bargaining coverage, which is relevant for 19 of the EU's 27 member states. These countries do not meet the 80 percent threshold and therefore need to establish action plans with measures to promote collective bargaining. Even member states with a collective bargaining coverage above 80 percent will be affected by the directive, as all member states are obligated to promote collective bargaining. The analysis further highlights how the Minimum Wage Directive, and its function in promoting collective bargaining, represent a significant change in the EU's governance of collective negotiations. Historically, a conflict between economic and social priorities has led to economic interests often dominating and limiting social rights. The Minimum Wage Directive thus marks a shift in the EU's social policy and underscores the importance of collective bargaining for improving working and living conditions within the union. (Less)

Historiskt har en motsättning mellan ekonomiska och sociala frågor lett till att ekonomiska intressen ofta dominerat och begränsat sociala rättigheter. Minimilönedirektivet markerar därmed en förändring i EU:s sociala politik och tydliggör vikten av kollektivavtalsförhandlingar för att förbättra arbets- och levnadsvillkoren inom unionen. (Less)
