- This master’s thesis examines the legal conditions under which the Swedish Transport Administration may close railway crossings and how such measures are implemented in practice. The study focuses particularly on the interaction between the Swedish Real Property Formation Act, the Swedish Railway Construction Act, and the property protection mechanisms intended to safeguard individual property owners during the process.

The study focuses particularly on the interaction between the Swedish Real Property Formation Act, the Swedish Railway Construction Act, and the property protection mechanisms intended to safeguard individual property owners during the process.
The study combines legal and empirical methods. The legal analysis covers relevant sections of the Real Property Formation Act and the Railway Construction Act, legislative history, and key case law. The empirical part includes a qualitative review of 24 cadastral dossiers and correspondence with the Transport Administration. The study also has quantitative elements through a compilation and categorization of cadastral procedures to identify patterns in their application.
The study shows that the Transport Administration possesses extensive opportunities to close railway crossings through cadastral procedures and that there are seldom practical incentives to establish a railway plan. The findings further indicate that property protection has limited significance in practice and rarely constitutes a genuine obstacle to the closure of railway crossings. However, recent case law and the Transport Administration’s ongoing work with railway crossing closures suggest that a shift in legal application may emerge.
Finally, the question remains whether constitutional property protection, as a potentially more far-reaching safeguard for individual property owners, may prevent measures that are otherwise permitted under the property provisions of the Real Property Formation Act, thereby potentially undermining the purpose of the railway planning process. Som en del av detta arbete stänger Trafikverket plankorsningar för att minska olycksrisker och möjliggöra högre hastigheter på järnvägen. Åtgärderna medför dock ofta betydande konsekvenser för enskilda fastighetsägare genom försämrad tillgänglighet, förändrade brukningsförhållanden och intrång i fastigheten.
Syftet med arbetet är att undersöka under vilka förutsättningar Trafikverket kan stänga plankorsningar, vilka tillvägagångssätt som finns och hur dessa tillämpas i praktiken. Studien analyserar därmed hur lagen om byggande av järnväg och fastighetsbildningslagen samverkar vid stängning av plankorsningar.
Arbetet bygger på en rättsdogmatisk analys kombinerad med en empirisk studie. Den rättsdogmatiska analysen omfattar tillämpliga bestämmelser i lag om byggande av järnväg, fastighetsbildningslagen, förarbeten samt vägledande rättspraxis. Den empiriska metoden innefattar en dokumentstudie av förrättningsakter, myndighetshandlingar samt korrespondens med Trafikverket, för att undersöka hur regelverket tillämpas i praktiken. Studien innehåller även kvantitativa inslag genom sammanställning och kategorisering av förrättningarna för att identifiera mönster i tillämpningen.
Av studien framgår att Trafikverket har stora möjligheter att stänga plankorsningar genom förrättningsförfarandet och att det sällan föreligger praktiska skäl att ta fram en järnvägsplan. Studien visar också att fastighetsskyddet har en begränsad betydelse i praktiken och sällan utgör ett reellt hinder mot stängning av plankorsningar. Samtidigt antyder senare praxis gällande tillämpningen av fastighetsskyddet, tillsammans med Trafikverkets arbetsprocess med plankorsningsstängningar ett potentiellt skifte av tillvägagångssätt. Slutligen kvarstår frågan huruvida egendomsskyddet, som ett mer långtgående skydd för den enskilda fastighetsägaren, kan stoppa åtgärder som fastighetsskyddet tillåter och följaktligen urholka syftet med järnvägsplan.
Sammanfattningsvis visar arbetet att fastighetsskyddet i teorin utgör en central garanti vid stängning av plankorsningar, men att det i praktiken har begränsad genomslagskraft. Trots att praxis uppställer krav om proportionalitet och skydd mot alltför stort intrång visar förrättningarna att bedömningen hanteras översiktligt eller inte aktualiseras alls. (Less)
