For a considerable amount of children school attendance is associated with daily torture and agony. Despite laws that regulate such behavior, violations of children’s dignity are common features in Swedish schools today.
On January 1 2009 a new Discrimination Act entered into force, which superseded the Act Prohibiting Discriminatory and Other Degrading Treatment of Children and Pupils. Also, a new chapter in the Education Act was added, the chapter 14 a, which concerns measures against degrading treatment in schools. For a considerable amount of children school attendance is associated with daily torture and agony. Despite laws that regulate such behavior, violations of children’s dignity are common features in Swedish schools today.
On January 1 2009 a new Discrimination Act entered into force, which superseded the Act Prohibiting Discriminatory and Other Degrading Treatment of Children and Pupils. Also, a new chapter in the Education Act was added, the chapter 14 a, which concerns measures against degrading treatment in schools. In that document degrading treatment is described as a behavior that violates another child or student’s dignity without it being discrimination according to the Discrimination Act. Due to this, the notions discrimination and degrading treatment were distinctly separated in the judicial sense.
The purpose of this paper is to examine the social attention that is paid to questions concerning bullying in Swedish schools. This is accomplished by studying the judicial changes mentioned above and by analyzing the work of leading scholars in the field. Ultimately, this leads to a discussion about the sufficiency of the measures taken to prevent degrading treatment in schools. (Less)
