Aktiva åtgärder -inte tillräckligt aktiva? En undersökning av Region Skånes Likabehandlingsplan i ljuset av den svenska och den internationella lagstiftningen

Denna uppsats består av två delar. Den första delen behandlar vad som sker då en likabehandlingsplan på en offentlig myndighet, i detta fall Region Skåne, utökar rättigheter för persongrupper som inte är skyddade enligt lag. Den gör en utblick över internationell rätt och EU-rätt för att söka ytterligare ledning till hur rätten ser ut i ett vidare perspektiv.

Då det inte är självklart vad som gäller har jag tagit hjälp av juristen och rättsteoretikern Wesley Newcomb Hohfeld för att utreda vad som på ett mer teoretiskt plan kan anses vara ”rätt” när utfästelser inte går att kräva ut på det sätt lagen är konstruerad. Denna uppsats består av två delar. Den första delen behandlar vad som sker då en likabehandlingsplan på en offentlig myndighet, i detta fall Region Skåne, utökar rättigheter för persongrupper som inte är skyddade enligt lag. Den gör en utblick över internationell rätt och EU-rätt för att söka ytterligare ledning till hur rätten ser ut i ett vidare perspektiv.

Då det inte är självklart vad som gäller har jag tagit hjälp av juristen och rättsteoretikern Wesley Newcomb Hohfeld för att utreda vad som på ett mer teoretiskt plan kan anses vara ”rätt” när utfästelser inte går att kräva ut på det sätt lagen är konstruerad. Hohfelds teori utgår från att den som utger en rättighet också genom detta handlande har en skyldighet att se till att den som rättigheten riktar sig mot kan tillgodogöra sig denna. På detta sätt förs resonemang kring rättigheter och skyldigheter, givna i lag eller i en likabehandlingsplan och dess rättsliga status. I framställningen behandlas även den rätt som eventuellt kan utkrävas enligt kollektivavtal och avtalsrätt.

Resultaten jag presenterar av den primära frågeställningen är att det råder diskrepans mellan diskrimineringslagens definition av persongrupper i aktiva åtgärder och Likabehandlingsplanens dito. Jag kommer att presentera hur en grupp av arbetstagare eventuellt ändå skulle kunna få rätt enligt Likabehandlingsplanen trots att lagen beskriver en annan situation genom att Likabehandlingsplanen ses som en del av det individuella arbetskontraktet.

Den andra delen av uppsatsen handlar om det intresse som finns, både hos mig och i samhället, att på det sätt Region Skåne har skrivit sin Likabehandlingsplan utvidga persongruppen som ingår i de aktiva åtgärder som är beskrivna i 3 kap. i diskrimineringslagen. Resonemang förs om huruvida denna grupp bör utvidgas i lagtext. Både för- och nackdelar med en sådan reglering kommer att behandlas utifrån aktuell SOU och dess remissvar. Resultaten av den andra delen av undersökningen visar på att flera utredningar förespråkar att alla diskrimineringsgrunder ska få utökat skydd under aktiva åtgärder, och även om frågan idag är oviss verkar trenden gå mot skyddslagstiftning på området.

Avslutningsvis förs en diskussion om hur en sådan skyddslagstiftning skulle kunna se ut och vilka konsekvenser detta skulle kunna medföra. Mitt förslag utgår ifrån att om man gör lagen enklare att följa för arbetsgivarna så kommer denna också att följas på avsett sätt. Det kommer att bli svårigheter att bevisa brott mot 3 kap. DL i den del där det inte går att mäta om någon har en egenskap som är en uppräknad diskrimineringsgrund, men detta borde gå att lösa på samma sätt som bevisbördan i övriga diskrimineringsmål enligt 2 kap. This essay is divided into two parts. The issue discussed in the first part is what happens when a public authority, in this case Region Skåne, expands their equal treatment plan to cover grounds of discrimination not included in the Swedish Discrimination Act. It also provides an overview of international and EU laws regarding discrimination.

The theories of jurist Wesley Newcomb Hohfeld are used to understand what could be applied when rights cannot be claimed because of the way the law is constructed. According to Hohfeld anyone who gives out a right to someone also has a duty to honour that right. It is concluded that there is a discrepancy between the definition of who is included in active measures in the Discrimination Act and Region Skåne’s equal treatment plan. I present a solution to how employees affected by this discrepancy could claim their rights by viewing the equal treatment plan as a part of their employment contract.

The second part of the essay discusses the potential change of the Discrimination Act to embody the grounds of discrimination included in Region Skåne’s equal treatment plan. Advantages and disadvantages regarding this is discussed using the Official Reports of the Swedish Government (SOU) issued 2014, and the comments on the report. According to several studies and investigations, including the SOU, all grounds of discrimination should be included in active measures and it seems as if legislation is heading in that direction.

The essay discusses how such a change of the Discrimination Act could look like and what the consequences would be. In short, my proposal is that if the law is made easier for the employer to follow, they will comply to a greater extent. There will be difficulties proving violations against chapter 3 in the Discrimination Act for someone not covered by the various grounds of discrimination, but this could be solved by applying the same use of the burden of proof as in chapter 2 of the Discrimination Act.
