- Ur ett internationellt perspektiv har Sverige ett högt anseende gällande jämställdhet mellan kvin- nor och män. Trots detta finns det en generell löneskillnad på 12,5 procent mellan könen. Att det finns oförklarade löneskillnader mellan kvinnor och män kan förklaras med att Sverige har en könssegregerad arbetsmarknad. Statistiskt sett finns det oförklarade löneskillnader, men Arbets- domstolen har inte avkunnat någon fällande dom avseende lönediskriminering sedan 1995.
Uppsatsens syfte är att studera och utreda rättsläget avseende lönediskriminering på grund av kön på den svenska arbetsmarknaden, och utifrån detta granska Arbetsdomstolens bedömning av kra- ven på bevisning rörande lönediskriminering mellan kvinnor och män. Uppsatsens syfte är att studera och utreda rättsläget avseende lönediskriminering på grund av kön på den svenska arbetsmarknaden, och utifrån detta granska Arbetsdomstolens bedömning av kra- ven på bevisning rörande lönediskriminering mellan kvinnor och män. Sveriges medlemskap i EU innebär att EU-domstolens förhandsavgörande och de principer som fastställts som vägle- dande när det gäller beviskraven, har kommit att influera Arbetsdomstolens domar i mål avse- ende lönediskriminering.
Uppsatsen leder fram till slutsatsen att lönediskriminering på grund av kön är komplicerat ämne, och att kraven på motbevisning från arbetsgivarens sida är för lågt ställda. Dessa krav skulle kunna höjas genom att ställa relevanta motfrågor från Arbetsdomstolens sida avseende de om- ständigheter som arbetsgivaren lägger fram som motbevisning i mål avseende lönediskriminering på grund av kön. Sammanfattningsvis bör Arbetsdomstolen bedömning av kraven på arbetsgiva- rens motbevisning ses över och större vikt läggas vid syftet med EU-rättens förhandsavgörande och dess principer i framtida domar. The purpose of this essay is to study and investigate the legal framework regarding pay dis-crimi- nation based on sex in the Swedish labour market. The essay will also include a review of the Labour Courts assessment of the requirements for evidence, concerning pay discrimina-tion be- tween women and men. Since Sweden is a member of the EU, the Labour Court inter-prets the preliminary rulings and the principles set by the European Court of Justice, as guid-ance in judgements.
The conclusion of this essay is that pay discrimination based on sex is a complicated subject, and that the evidentiary for the employer is low. The Labour court could increase the require-ments for evidence, by asking relevant counter questions regarding the employer's rebuttal. In summary, the Labour Court's assessment of the employer's rebuttal needs some adjustment with reference to the purpose of EU law and its principles. (Less)
