Arbetsmiljön för distansarbete i hemmiljön är ett outforskat och nytt område för arbetsrätten. Denna uppsats granskar rättsläget för distansarbete och arbetsmiljö med hjälp av en rättsanalytisk och rättsdogmatisk metod för att besvara de övergripande frågeställningarna “Hur förhåller sig arbetsmiljölagstiftningen till distansarbete i hemmiljö?”, samt “Vad är arbetsgivarens ansvar för arbetsmiljön vid distansarbete i hemmiljön?” . Genom en teleologisk tolkning ser uppsatsen till arbetsmiljölagen och ett antal av Arbetsmiljöverkets föreskrifter som appliceras på en situation som inte är behandlad i domstol eller doktrin. Arbetsmiljön för distansarbete i hemmiljön är ett outforskat och nytt område för arbetsrätten. Denna uppsats granskar rättsläget för distansarbete och arbetsmiljö med hjälp av en rättsanalytisk och rättsdogmatisk metod för att besvara de övergripande frågeställningarna “Hur förhåller sig arbetsmiljölagstiftningen till distansarbete i hemmiljö?”, samt “Vad är arbetsgivarens ansvar för arbetsmiljön vid distansarbete i hemmiljön?” . Genom en teleologisk tolkning ser uppsatsen till arbetsmiljölagen och ett antal av Arbetsmiljöverkets föreskrifter som appliceras på en situation som inte är behandlad i domstol eller doktrin. Detta kombinerat med policys och anvisningar från tre olika organisationer, Lunds Universitet, Intraservice Göteborgs Stad och Helsingborgs Stad analyseras för att utreda risker, ansvar och åtgärder.

Slutsatsen är att det övergripande ansvaret för arbetstagares arbetsmiljö även i hemmiljön är arbetsgivarens och att gällande rätt kan appliceras på denna situation. Riskerna som kan finnas är belastningsskador på grund av utrustning och fysisk arbetsmiljö, och psykosociala risker såsom information och kommunikationssvårigheter, arbetsbelastning, arbetstid, kränkande särbehandling och gränslöst arbete. Arbetsgivaren måste anpassa det systematiska arbetsmiljöarbetet för att fungera även vid distansarbete, vilket innebär ändrade riskanalyser, policys och sätt att undersöka, åtgärda och utvärdera arbetsmiljön. Abstract
The area of work environment for remote work from the home is a fairly unexplored area of labor law. This thesis reviews the legal aspect of remote work and work environment using a legal analytical and legal dogmatic method to answer the main research questions “How can work environment law be applied to remote work from home?” and “What are the employer responsibilities for the work environment during remote work from home?” . The thesis uses a teleological interpretation of the Work Environment Act as well as the regulation of the Swedish Work Environment Authorities. The area of work environment for remote work from the home is a fairly unexplored area of labor law. This thesis reviews the legal aspect of remote work and work environment using a legal analytical and legal dogmatic method to answer the main research questions “How can work environment law be applied to remote work from home?” and “What are the employer responsibilities for the work environment during remote work from home?” . This is combined with internal policies of three different organizations, Lund University, Intraservice Göteborgs Stad and Helsingborgs Stad to analyze risks, liability and actions to improve the work environment.

The conclusion is that the main responsibility of an employee's work environment during remote work in the home is still the employer’s, and that the current laws can be applied. The risks that can emerge are stress injuries, psychosocial problems such as information and communication difficulties, an unhealthy workload, long working hours and difficulties managing boundaries between working time and free time. The employer is obligated to adjust the systematic work environment management to function during remote work. This means changed risk analysis, policies as well as adjusted routines to examine, remedy and evaluate the work environment. (Less)
