- This entry provides an analytical account of the Convention on the Rights of Persons with Disabilities (CRPD), examining its emergence from the failure to realise universal human rights for persons with disabilities and the participation of organisations of persons with disabilities in its negotiation. - This entry provides an analytical account of the Convention on the Rights of Persons with Disabilities (CRPD), examining its emergence from the failure to realise universal human rights for persons with disabilities and the participation of organisations of persons with disabilities in its negotiation. It examines the Convention’s origins, the breadth and structure of its rights, its understanding of disability, the role of its general principles and its detailed framework for implementation, monitoring and accountability. The entry demonstrates that the CRPD’s distinctive contribution lies in making explicit how universal human rights must be interpreted, implemented and monitored in the lives of persons with disabilities, rather than in establishing a catalogue of disability-specific human rights. Particular attention is given to equality and non-discrimination, including reasonable accommodation and the relationship between equality and rights-specific requirements. It concludes by identifying interpretative and implementation challenges where established legal and institutional arrangements remain in tension with the Convention’s demands. (Less)
